Amazon’s TRILLION Dollar Marketing Strategy (REVEALED)

In particular, I’m going to be talking about their two main slogans: low prices. These aren’t really slogans but they’re they’re, two main promises, low prices and fast shipping.

This has been their core motto from day. One Jeff Bezos has said: customers want lower prices and he realized they want faster shipping and all the company is focused on is purely low prices and fast shipping and they’ve never gone away from that, and one thing you’ll notice is in Amazon’s growth, particularly here in The United States you’ve seen that Amazon has taken their shipping down from days to one day, even same-day shipping on many items, but what’s even more important to understand, is when Amazon says that your product will arrive the next day or the same day is that they Uphold their promises – and they do so spectacularly now, if Amazon had a reputation for promising same-day shipping or next day shipping, but then having that delayed.

You know a couple days: they wouldn’t be a trillion dollar company today and if you remember it’s almost hard in American. Imagine life without Amazon you used to buy products on the internet and you’d have to wait a week or more, maybe even multiple weeks to get a product shipped to your house. It depended on the retailer, all sorts of different types of quality and concerns, but with Amazon they’ve kept it consistent.

They’ve consistently stayed true to their marketing message and they’ve, always under-promise and over-deliver. Sometimes you even get your shipment faster than what they claim so Amazon’s done. A spectacular job of keeping it simple now in order to grow their business in 25 years to a trillion-dollar company. Amazon’s done three things amazingly, and these are three things that you can do in your core business to help yourself grow, whether you are working for yourself or you’re, working a job marketing job at a major company.

First, off they’ve created very simple core benefits: okay, low prices, fast shipping – that’s it they’re, not focused on anything else than these simple core benefits. Another thing, they’ve done amazingly, is their consistency. I’ve been using Amazon for over a decade and over that entire time, they’ve never been late on their shipment. I haven’t ever worried about where something was they’ve been amazingly consistent with their service and their shipments, and the pricing has been cheaper in almost all cases.

I’ve ever looked on Amazon and the third thing is marketing and mission alignment. It’s not just the marketing department that is focused on promoting lower prices and faster shipping. It’s the entire company. It’s the business development team. It’s the technology team, it’s their warehousing. Every part of Amazon’s business is built to give people lower prices. When Amazon was trying to ship things faster, for instance, they realize the only way they could ship things even faster was building their own network of warehouses, and so they did it.

They spent tens and tens of billions of dollars building their own warehouses, and then Amazon realized that sending people walking through long stacks of shelves was a very inefficient way of getting products and getting things in boxes. And in order to move to a system where they could do same-day shipping, they needed to work faster or sorry next day shipping they need to work faster, so they actually innovate.

The whole factory model factory workers don’t actually even walk in Amazon anymore. They get boxes delivered to them, our items delivered to them by one robot and they pull those items off of the one robotic shelf and they place it in a box in the other, robotic shelf, and they do this all day with new, robotic shelves coming in. Every couple seconds there are new, robotic shelves coming in now, if you’ve seen the PBS documentary you’ll, see a number of workers saying that it’s sort of inhumane and the pay isn’t good for the amount of time they work them, but ultimately, Amazon.

Their core mission is lower prices and faster shipping, so they’ve built every step of their business around creating faster shipping and lower prices, and they do not waver from it even in the building of the factories and the automation of their factories. Their development of drone delivery technology, every part of their business is purely built around delivering the customers. These two things now this is a new article format.

Working from Home | Office Tour

Guys have been asking for this, so I figured. I would just show you around a little bit in the office. Give you a little bit of a detailed look of what I need on a day-to-day basis to do my job. My actual job title is a process engineer and what that means is I interpret drawings from design engineers and calculate out material for it to be fabricated.

That’s kind of the easiest way to describe it. So basically I look at prints and drawings all day as well as I do a lot of math. So that’s kind of what I do and it’s all not all of its data entry, but a majority of it is data entry and entering it properly into our systems to make everything work. So this is my second bedroom, and this is now an office I used to have it as a guest room, but I converted it into an office quite a while ago, as you enter we’re going to look down right now.

Cuz Doyle is there sleeping doing his due diligence as the coworker, and let me give you like a little desk to her right now, since we’re dealing with kovat and all of that stuff. I have like a little heart thing. I actually got this on Amazon yesterday. This came in it’s like a little rope rainbow and I thought that was really cute. So you know I have my little my cute little valence here so yeah, I’m going to link as many things as I can find it down below for you guys over here.

Actually, let’s start with this wall, so clearly this is not required, but I have these prints on the wall. I got them from home goods, I believe, like home goods, our Marshalls. I can never remember which one, but I got them at the same time, they’re beautiful they’ve got like some sparkles on them and I just love like the gilded frame. I think that’s so so sweet so pretty anyway. Over here I have a little envelope opening thing.

I have right now just a little book in there, but I actually do keep like my paper bills in there. Anything that gets mailed to me that I have to like financially take care. I will put in there as a reminder and then, when I deal with it, then it goes in the file cabinet, which I will show you in just a moment. I have two of these lamps, which are on both sides flanking got those from Ikea. I also have this little funny-looking thing um, that is a tripod like.

I can actually put my camera right here. It’s like a little mount. I will link it is actually already linked below, but it works really well for my set up when I you know, do planning articles and such over the corner. Here are my planners that I got in PR that I have some things I need to do with or like deal with with them. I also have some stickers and I’m going to be doing a haul with I have more stickers coming, so I’m just kind of stacking them there for the moment over here I have this really cool, washi, cart and a bunch of simply gilded washi.

You got ta have hand cream, especially now, when we’re all washing our hands like crazy and then over here I’ve got some calendar set ups, so this is a firm Erin Condren. Those planners are from Erin Condren as well, but this is from Erin Condren. This was just kind of keeping track of my vlogging, and things like that and like what I needed to film so today is actually the 28th. I did a little bit of decorating, but not not too much so yeah, today’s the 28th and then I’ll be posting.

This, I don’t know at some point I actually got this acrylic easel, like a critics, stand on Amazon the other day, and I really like this a lot. I like that that just like sits there and I can see it cuz. I’ve got a lot of things going on so yeah like that. This is today and I’m down here, filming filming things, I’m filming things so yeah, but that’s that over here just some stuff. I need to deal with there’s some ups returning labels that I still need to hold onto until amazon credits.

My account I have like a little. I call it a washi cutter, it’s not it’s actually a bookmark, but I use it to cut washi. I just leave it right here. Then inside of here is a bunch of markers from Erin Condren, so we have that I’ve got a little coaster, because you need a coaster for all your good stuff. I also have some just random sticky notes. I was writing some sticky notes. I got ta put away whatever and then I have a new pad of sticky notes, so I just always have a fresh pad of sticky notes already and then I have a bunch of pens.

I just kind of put them in there. It’s easy, I’m right-handed, so it makes sense when I’m at my all my monitors that I have it on the right side. I also have my phone and it’s on a little stand right now, it’s being charged. That’s really easy to like you know, do this or have it sit like that, like for article calls or what have you and then I also have a wireless, keypad and mouse that all gets connected into this bad boy over here, which is my laptop and then Over on the side, here I have like a big pen holder, but um.

You know this doesn’t really fit anywhere else on the desk, so I just put it over there and then, when I need pens, I just throw them in there cuz it works, so they usually just use the same two or three over and over again, and if You guys are wondering I got my desk at IKEA. I can’t remember the name of it but um I had to you know everything was separate, so you got the file cabinets and then the top and the one-leg all separately, so yeah and then the chair.

I actually got on Amazon. I will link that below and then I think I got like everything on Amazon for the most part, and then I’ve got this, which I actually got the other day there I’ll make it look pretty for you. You can kind of make it look funny here, but this is supposed to help with, like I don’t know your nerves or something. But anyway I did read on the Amazon reviews that this can kind of stain your chair.

So I put a your encountering Sherpa throw down, so it didn’t stay in the white anyway, but it seems to be working just fine and I really like it and then underneath my chair. I actually have a foot roller because I have plantar fasciitis in my feet and that helps moving over here. I have all my chords just like a hot mess, but they are it’s a labeled hot mess. You guys and then I have my paper shredder.

I’ve got my printer, which I really don’t need to use to be honest for the most part, but every once in a while. I do need to physically sign something and then scan it. So it’s nice to have this, and this is a LaserJet printer and I absolutely love it and I’ve had it for a few years now and I really really like it. As for the file cabinet, it’s a three-tiered file cabinet also from Ikea, had it for several years now.

This tiered cart is from Ikea everything’s for making you guys – and this is my planner cart – that has all my stickers and all my washi and sticky notes and all my little doodads to decorate my planner, which is right over here. So you know I needed to put something in my planner or whatever I can just wheel. The cart over and plan and then over here is nothing really interesting. I have these two bookcases there, the billy bookcase – and this is what the inside looks like.

I really don’t have much going on in either of them. This used to be storage for my Etsy shop, which is no longer in business because it was just too much. I didn’t need to do that anymore, so I just said sayonara, and this is all the extras and then on top here I just have a little bit of tissue, another little organizer. This one is from home goods and then I’ve actually got some like these. Are these two are like work notebooks and then I have another work thing here.

This is a medical binder and then this is also a medical like binder slash tracker. So that’s basically it for my at-home work set up. I try not to up here, but it’s really, I feel like it’s super difficult right now, just with everything going on what I’d like to do is work when I’m working from home there’s a dog right there is I like to take him on a nice long, Walk usually about like 10:00 10:30 somewhere in there.

That kind of just helps my brain. Like I, you know in the morning I check my email. I get all my emails out do all of that good stuff and then once it kind of dies down just a little bit I’ll, take him out for just a little bit of a mental break. You know, like a 15-minute, walk, something like that. He’s getting really excited when I’m saying anyways and then yeah, I grab some water or whatever take my coffee or tea or whatever I’m drinking for the morning and oh, don’t worry your curse, um and then take that downstairs and then you know bring up bring up.

Some water or juice or whatever I want to drink, and you know kind of reinvigorate a little bit so yeah. But let me back up a little bit here: I’m going to back that train up here, come on Doyle, so yeah. That is it for my working at home office a set up. I hope you guys enjoyed the article and enjoyed just a little look at the office. I you know don’t use too much pen to paper, except for my little notes.

I do have to write myself little notes once in a while, but that’s about it. Everything is digitized. I send over all my completed work actually to my boss. He goes from there because he’s actually in the office right now. I think he’s he is the actually. The only person in the office, everyone else is working in production and they’re, taking all their precautions and things like that, and they actually all work more than six feet away from each other, so not sure when I’m actually going back into the office.

That has not been announced yet, but um yeah I’ll try to get this article up for you guys and then I will, like I said before. I will link as many products as I can find down below and then, if you have a home office set up, do you have any like tips or tricks or little things that really help you? You know, like the dog, helps me because kind of breaks up the day and things like that, but yeah right Doyle.

Life & Apples Wellness Planner | First Impressions

This is the undated Life and apples, the wellness planner. It’s a daily motivational journal for healthy living and it says active life, balanced eating and happiness. This is something that is available on Amazon. I will leave a link below for you guys.

I am currently looking on my Amazon and it is retailing for $ 24.97. I just wanted to let you all know that and then there’s some information on the back as well. So it says the wellness planner, a daily planner and journal for staying healthy, motivated and inspired. It helps you focus on your diet and fitness goals, eat healthy and plan meals, lead an active lifestyle and stay fit, build and maintain positive habits, feel accomplished and happier, and then down here it has 240 pages, it’s a 90 day layout or it’s a 90 day Daily layout, I should say: there’s meal planning, a food journal, gratitude, fitness schedule, goals, weekly review, a habit, tracker and inspirational quotes, so their website is life and apples.

Calm, but, like I said you can get it on Amazon as well. First things: first, there is this elastic band closure, which I do like for these kind of more like softer planners, and let’s pull this guy off here all right here we go. Let’s take take it off. Oh it’s naked now so anyway, on the front, it is like a nice kind of a know like a faux leather and it’s going to be kind of hard to see, but maybe you can see it, but there is like a little embossed Apple on the front.

The spine is just like a softer leather as well, and then the back is just plain but embossed on the bottom. It says life and apples with a little apple on that as well. There is a little pen loop, which is really nice. So, let’s open this bad boy up and it does feel nice. It’s not like a gritty feeling. It’s like a very smooth feeling, even though there’s definitely like you know some. It looks like there’s texture to it, but there’s not, but I don’t know I don’t know.

I don’t mind it so anyway, there’s a little card in there that says, download your free, healthy living, ebooks and printables at life and apples, calm, a /pages, a slash going to sand. It looks like you can sign up to get a 10 % off coupon on your next order. If you sign up there, that’s cool alright, so first impression of opening it. I hadn’t opened it yet. The paper feels nice. It feels thick, but it’s like the front page, so it might feel a little different.

So in the front it just says life and apples, the wellness planner undated, alright. So oh, this is like stitch bound. Oh that’s cool! Alright, so it has different sections. So section 1 is mind, set concepts and guidelines how to use this planner a self-fulfilling promise. Section 2 is a daily planner and weekly project progress. I can’t talk today here: goals daily planner wellness, no daily wellness planner.

I told you guys. I can’t talk today. Weekly progress review and then section 3 is your progress and inspiration, a review, exciting things ahead and notes cool alright. So here is just some information on mindset. I’m not going to read this whole thing because I want to get through this a little faster for you guys, so you can kind of see the inside of this a little bit. So I think it’s just like about talking about what this planner is.

All about is what it kind of looks like of like how to set a short-term goal daily motivation. Things like that, so yeah, oh and then there’s like a little thing of like how to use this planner cool. So it talks about like gratitude affirmation active day. Today’s meal planning a wellness summary and all that good stuff. Alright, so, oh you have to make a promise to yourself. Apparently, when you have this planner all right cool.

Well, let’s make a promise y’all, so the promise to myself the day and date. I will use this wellness planner to create a lasting positive change in my health and wellness, and then you know why basically, but why you want to change it and then you’re prepared to change and commit and then sign it, alright. Okay, this has a lot of structure to it. So if you guys know me in any of my planner styles, I really don’t like a lot of structure, but I think this would be great for somebody that likes a lot of structure, especially if they’re trying to get motivated with meal planning meal.

Prepping being active things like that, so I mean I haven’t looked through the rest of it, but I can just already kind of tell that it’s going to be a lot of structure. So anyway, you got my goals. So then you can put in a bunch of goals, so your goal and you want to achieve them by and then the action steps and there’s three lines with little faint checkboxes. And it looks like there’s five on this page and then now we are into the daily planner okay.

So it’s one day on two pages, so you have the day end date, which it’s undated. So you can start this at any time. You write what you’re grateful for your daily affirmation your active day. It says, exercise workouts and opportunities to keep active today, and it’s got seven different lines with checks and then notes. It says today’s priorities to do special events, etc, and seven category or seven lines as well with little checks.

So I mean clearly you would use this for like food and activity tracking. But if you had like two dues like hey, I need to run to the store. I need to go grocery shopping or I need to like pick up the dry-cleaning like you could put that in here. It looks like and then down at the bottom. It says Universal wellness elements, are you getting enough question mark and it says: Erin, sunlight, water and nutrients, joy and fun, and sleep sleep is something that I definitely struggle with.

I don’t know if you guys struggle with it out there, but I definitely struggle with sleep water. I don’t struggle with that at all. Alright, so over into the right hand, side over here it says today’s meal plan and then it has breakfast and some lines. Lunch dinner and snacks, so you can either plan that ahead or you can even just write it in as it happens, this is small enough that it would definitely fit and I think, most people’s purses.

Let me see if I can find the size on the interwebs here all right, so this is five and a half inches by eight inches. So yeah I mean you could definitely throw this in your bag or your work bag or keep it on your desk at work or just keep it at home too. I mean it’s definitely small enough where it could suit those needs, and it says on the scale of one to five. How was today and how well did you follow the plan and it’s one through five and it just says what could be improved tomorrow? Then it’s got like a little quote from George Eliot and says the strongest principle of growth lies in the human choice.

Isn’t that the truth? Gosh, it’s getting it’s getting deep on the FDA Channel today, all right and so day and date all over again – and I believe hmm, let’s see here all right, so you’ve got a whole week and then you have a weekly review. So you have your day and date, success and wins. Oh and all the days are the same like the day and date and then like your today’s meal plan. All of those are the same throughout the seven days.

So your weekly review, you put the day and the date successes and wins, and so celebrate your wins. What were some of the motivating moments, people and things that helped you have a healthier week and then you have three lines to write about that and it says: needs improvement. How can you make next week a healthier one, any pitfalls to avoid and it’s got three lines? The next section is insight and lessons.

What have you learned about yourself this week and three more lines and then over here is the weekly progress tracking and it says, track your daily bi-weekly and weekly healthy habits. So it’s got three sections here and then Monday through Sunday, so you can either check that off or you know, if there’s a certain amount of ounces of water or something like that, you could do that as well and then over here it says, track your progress Towards your goals, use parameters like weight, number of weekly, workouts, new habits, etc, and it says, parameter this week.

My goal that’d be nice. If you’re trying to fluctuate your weight or something like that and then weekly notes, it’s got a bunch of lines and some checkboxes as well all right. So then, we’re back into the week again all right, and then you got another weekly, okay, let’s kind of see what else is going on. I kind of like that. This is stitch because it like lays like it lays flat. Like I don’t know, if you guys can see that, but it does lay flat it’s hard to see because I like tipping it up, but it does lay flat which is kind of nice.

It does have these as well these little ribbons Wow words are hard today. So you could ideally have one of them for your day and then one of them for your week, especially if you’re going to do one of those like weekly habit, trackers or their parameters or something so yeah. But let me find, if there’s anything else going on in this planet, that just might be it I’m not really sure. So, let’s take a peek here and then I’ll talk about paper quality in just a moment.

Okay looks like that’s all the same. Oh, oh there’s different pages hold on hold on hold on okay, so in the back okay. So this is, after all, of the 90 days, so in the back, it has review Congrats on your commitment to a healthier life, write down the accomplishments that you’re most proud of in detail. What you need to continue and improve on your journey to wellness. It says I accomplished and says: look back at your goals and notice the progress you’ve made, what are your big list accomplishments and you can write them down and says I’m committed and then exciting things the head.

Oh and then you’ve got a bunch of notes. Pages. Very cool, alright, so we’ve got 3 1 or 1 2 3 4 line notes pages and then you’ve got 1, 2, 3 3 normal pages that are blank. And then this one’s like more of a Oh 5 normal pages and then this one’s one more like a it’s, not cardstock, but it’s like thick, oh and then in the back, there’s a little pocket. So you can put you know like a something in there.

Some secrets or something so yeah, so this is the planner yeah. So the paper/quality feels pretty nice. It is a little thinner than like the Erin Condren. If you guys readed my regular planning stuff, I use an Erin Condren, it’s a little bit thinner than that, and I can tell by the ink saturation underneath as well. I don’t have time to do a pen test today, I’m kind of in the middle of doing a whole bunch of things in my home right now.

So I don’t have time to do that today, but I feel like any like regular, like ballpoint, not ballpoint, but yeah a ballpoint pen or like a gel pen would probably be really nice with this. Like I said before, there is a ton of structure with this planner like a lattice structure with this planner. So if that’s something that you’re really seeking, I think that this might be a really good. I for you, if you really want to get motivated with your food, and your fitness and tracking things like this might be a good one for you.

I know that some people have a real trouble with planners that don’t have any structure at all. I kind of thrive on minimal structure, which is probably why I’ve never gotten into bullet journaling, because there’s like no structure with that. So I do like my Erin Condren hourly, because it just gives me hours and I can put in what I want to put in. That’s like great for me, but any more structure than that.

I don’t like so this isn’t something that I would definitely use. However, I can see the value in it for sure, especially if you’re someone that just needs to have a question posed and then write it in so like having a category to say, hey. I am grateful for this, and these are my notes – and this is my lunch plan like that – I can totally understand how that works really well for some people, so I think the planner is pretty cool.

I actually really like the size of it just for portability, because if I were to use it, I would want to take this on the go and grab my pen and take it. You know to the office or take it to visit friends or whatever and like really keep track of stuff, because if that’s what this planner is all about with tracking things, it’s just something that I would definitely want to be portable, which it is it’s quite light.

As well, it’s really nice, it’s not bulky, it’s very thin, so I do like that that it would fit in in most purses. What that means to us is this year’s. Coming to a close there’s, a lot of opportunity to pull as much sales revenue as humanly possible out of these last couple of weeks for us when de Amazon sales, usually right around 18th to 20th right Amazon sales start dropping actually maybe early 20s, like 20th 21st. Basically, when people can’t buy something and it can be at their house for the holidays, that’s when Amazon sales stop dropping off.

So right around that early 20s, 20 20. First people stopped buying as much on Amazon, and then we see some of our slowest sales phase on Christmas. Specifically, New Year’s is pretty slow and the days in between it’s just not our best week. It’s probably our worst week all year, except for that week. Maybe in July, where everybody travels on vacation travel, yeah, yeah, yeah, that’s true yeah, but there are some ways to increase those sales and not only increase those sales.

But there are some things you should be looking at. Taking that time of slow sales, instead of refreshing, your sellers app 67 times to make sure you’re making money to plan for the future and that future is 2020 a brand new decade to crush it. That’s exciting, are you excited about 2020 yeah? I didn’t realize. There’s a brand new decade till you said it yeah like a whole new decade. That’s crazy! This decade was crazy.

Yeah and years. Yeah was 2010 yeah 2010. What were you doing in 2010? Oh, it was a good year. 2010 was 2010 according to Sebastian was a good year, just not for me just according to Sebastian. It was a good year for everybody else, just not for him, but 2019 was a phenomenal. 2020 is going to be even better, so yeah yeah 2020. It’s going to be a game-changing year for us, we’re continuing to innovate within our warehouse and within our production and within the realms of control.

We have, within the Amazon Marketplace, to kind of continue to grow, become and maintain. Our presence is one of the largest Amazon sellers in the country, which is it’s it’s a challenge: yeah, of course, the market, the environment, the products are constantly changing fluctuating and we want to stay ahead of the curve, whether it’s the way we source products or whether It’s the technologies that we’re bringing to help us be more efficient, mm-hmm, absolutely absolutely so.

Some things to keep in mind to grow your Amazon business in 2020. Now that the years coming to an end – or you know definitely building as many relationships as possible in 2019, especially in these last couple weeks, right before everybody is on vacation for the holidays, is creating as many accounts, if you’re, if you’re going the wholesale route, as Humanly possible, or even if you’re doing, the private label route talking to as many manufacturers as possible and even if you’re doing retail arbitrage building relationships with the managers of the stores that you’re doing retail arbitrage with right.

So you can get that backroom access that side door access right. You can get access to those pallets that they have an influx of or the returns or or the discounted products before they hit the shelves and with December 1st right around the corner. If you have not, I’m going to assume you had a profitable year, but if you have not spoken to a CPA, yet you need to in order to try to lower your tax bracket and and lower what you’re going to be paying for 2019.

Well. In April of 2020 for 2019, you know we’d like to meet with our CPA, at least quarterly, at minimum and same thing with you guys, if you have any last-minute purchases that you can make, if you’re planning to make a big purchase in 2020 December might be The time to make that purchase to lower your expenses, but I would first of course, speak to your CPA. If you don’t have one, you need one at the end of the day, cost a couple dollars couple shekels, but it could save you a couple.

Shekels yeah and then some yeah, like some things, we’re going to what are some purchases we’re going to close out before the end of the year. We just talked about some travel expenses from looking booking some trips for next year. The end of this year, we’re also going to be your house equipment. Yes, that’s a warehouse system, warehouse equipment. Also, some advertising, yes, it’ll – be going a little more aggressive spending some more money on advertising.

So we can write that off as well. Also, some other equipment like camera equipment and lighting equipment. Stuff like that so anywhere, you could spend additional money. It’s it’s definitely good for those 2019 taxes, but, like Sebastian said we’re not CPA. So talk to some talk to a professional right. Now we operate a 90 percent wholesale business, 10 % private label. The private label is growing Sebastian just created it’s actually sitting over here about three feet from us.

We got a full pallet of products that Sebastian created and I’m super excited about them. We’re currently building the listing as we speak, he was just on the phone with one of the team members who’s, helping us build this and and we’re excited about it, but something to consider right. We built this business Sebastian built this business on retail arbitrage, and I think something that a lot of you may not be capitalizing on is what we touched on a couple minutes ago and that’s building relationships with with store managers and and what that could look like Is like you have to sell yourself to them and make them know believe that you can bring them value all right.

It’s something that comes to mind is like explaining to them the time they can save by offering you those discount racks before they even have to load up the racks, because what that means is hey, they give you a call: hey, John, hey Stacey, whatever your name Is I got 50 products I’m about to put on the discount rack? Do you want to come pick them up? It saves them time. They don’t have to pay an employee to fill that discount rack just to have you come in with your arm and swipe it all into your grocery cart, and then they have to reload it again and refill it again.

And then you come the next day and swipe it all into the grocery car. So by you presenting this idea to them, it could actually save them time, which saves them money and save you time, which saves you money, so it works out for all parties. I mean right from the get-go. You want to try to build any relationships you can. That could be advantageous to your business early on in our a you know. For us, we also became close with some of the manager at the different stores and some of the employees there, and they would reach out to us like Eric said, and let us know when things were going on, sale or for palette of a product came in.

They would call us before they even put it on the floor. Knowing that, like Eric said, we could come load it up in our van and and just leave, and they would never have to even put it on the show floor, and we also, of course took care them. You know, throw throw them some holiday money. You know just just really take care of them, and so it was advantageous for both parties, us and them yeah, really any relationship you’re building.

You need to look what value you could bring to that relationship if you’re, just looking for what you can take from the relationship that relationships not going to work Sebastian talks about all the time. It’s like a girlfriend boyfriend relationship or any significant other relationship. It’s a take give take given the gain relationship you can’t just take, take, take and expect the other person to reciprocate.

It just doesn’t work like that, and business relationships are the same exact way, so you need to give in order to receive and it’s revolutionary it’s. It’s it’s. How we’ve built the relationships we’ve built right, yeah yeah, I mean listen. We’ve had a lot of help from some of our our suppliers. You know billion-dollar companies why? Why do they want to team up with us? Well, they want to team up with us.

A because they know that the way that we handle our business is with integrity and B, because it’s a take give relationship where we’re always trying to help them grow and any opportunities that we see come to the marketplace. We bring it to them and bring up ideas to them about moving certain private label products that they may carry, or just inventory that they might have that stale. So it’s not always about what we can gain from them.

It’s also about. How can we help them to grow yeah? We continue to build relationships. It’s still the foundation of our business Sebastian just smashed a catalog on my desk from a a new distributor that I plan on starting to place an order with this week. So I’m excited about that. It’s one of my favorite things to do is place new orders with new companies, but with placing new orders with new companies comes a lot of sometimes a lot of issues, especially with some of the companies we worked with.

Like I forgot, it was like the small little toys, but they came like K packed with six different kinds. You know – and you know so, there’s issues and the first time you place that order. Sometimes we like to be a little less aggressive. So if there are issues with the products coming in, we didn’t go, spend $ 50,000 on a first order rule. Maybe you only spend $ 5,000? So if we have to eat some of those issues because we’re we don’t want to call them and be on the phone with them complaining for 20 minutes about the mischiefs or the the mishaps, because that’s not good for a relationship, we don’t invest a huge amount Of money in that first order, so it doesn’t tarnish the relationship if something goes wrong with it right and with any new new supply.

You may pick up, please be conservative at first, just because the character said kind of just. To reiterate, you don’t know the quality of the product, you don’t know the quality of the company, you don’t know how they’re going to handle your delivery. I mean remember there was that one company we were dealing with and they had the Sun on the products. Yeah, a couple of their products had like just a heavy layers, warehouse yeah, and so you, you don’t know you know when you’re first ordered with a company.

You really don’t know how they handle their products, and so you want to be conservative on the first. Second order, and then from there you know you, you start growing, that hmm absolutely absolutely so. What are we doing in these next couple weeks to kind of wrap up the year for the Amazon business? Well, we’re kind of looking at our numbers we’re going to sit down like we always do and kind of look over the year.

Look over the data and see areas where we can improve and then we’re going to pass that information on to our managers pass that information on in meetings with our buyers, with our warehouse with our developers and really set the goals in the agenda for next year. You know last two weeks of December is really about Synagogue goals for next year, where do we envision ourselves being and how we going to get there kind of building the roadmap yeah? Absolutely it’s exciting time and and something one of my favorite things that we do at the end of the year is we review all our distributors and – and sometimes this is one of the most challenging things I think for for us to do sometimes is let go Of a distributor that for years produced us ton of revenue, ton of profits, but now their product costs just aren’t cutting it for us anymore.

So it’s it’s important to know as a business when that retail store you’re going to the prices just aren’t competitive anymore or when that man facture you’re dealing with for your private label product the prices just aren’t competitive or when that wholesale or distributor their prices. Just are too high and you need to let them go it’s important. It really separates the winners from the losers when you can make that conscious decision like I need to find a new company to do work with and even on a more micro level to just a since we’ve had a since that we were selling truckloads of truckloads Of and because the climate of the Amazon environment is always changing, we’ve had to let go and it was hard, but every time we let go, it gives us opportunity to find another one and we do and we do and so will you so just because a Aysen that was once profitable, maybe right now isn’t doesn’t mean you need to hold on for dear life, hoping that we’ll get better again.

Sometimes you need to let go and look for a new investment, a new Aysen, to really take over that space of where that last one was yeah. We have them speaking at good asons. We have some killer asons right now. In November man we got. I was just looking: we have so many scenes, bringing us three thousand over three thousand dollars a month in profits and their seasonal yep all right. So these are products that the rest of the year would bring us little any profits if any, it would just build up storage fees if we sent it to Amazon, but because it’s tis the season we’re crushing it pulling in $ 3,000 in gross profits a month From these products yep and we have over 4,000 activations, you know – and you know it fluctuates, but I always say building that healthy portfolio, that healthy online account that healthy business – and this is how you do it.

You have those high profit items that might move a little slower. You’ll have high profit items that move high-volume, then you’ll have low profit, low volume and everything in between and that’s what builds a healthy business where year-over-year we continue to grow this year is, but by far our most profitable year and last year was a most profitable Year today, as well so – and it’s like that, every single year, as we continue to redevelop – and I think part of that goes into looking at the year kind of looking back, seeing the things criticizing ourselves seeing where we could improve and then building the roadmap.

For next year, yeah yeah, so based on that trend, 2020 is going to be killer, killer killer, no seriously where we have some cutting edge stuff for 2020. You know I went to. I went to Costco the other day huh for our Thanksgiving party to get some pumpkin pie – scamming yeah I wanted to I wanted to, but they got the bill deals on everything over there. Well, we used to do a lot of purchasing from Costco 20 years ago and uh, and it’s just every time I go there.

It takes me back just special and I would go there for six seven hours a day and just scam products, and you remember that transition right where it was like where he went from doing it five days a week to four three even one day a week Was challenging because the wholesale part took over call and people always ask us like? When do you know it? Just kind of happens, you’ll know because it happens, because you have a wholesale, a cow or multiple wholesale accounts that are taking up so much of your time that you don’t have any more time for all right, yeah and then – and it’s just like even at the End there we were still going once a month yeah we were placing monthly orders from our from our retail stores.

We were doing business with to supplement some of the income that in the revenue, so we could continue to grow. So it’s like it didn’t. It took. Probably a year and a half before we completely cut off retail arbitrage and we came, you know 90 % wholesale business mm-hmm so so get it where you can get it get it. What you know if you’re selling books right now and books, are your bread and butter and you’re trying to switch to retail arbitrage, don’t stop selling books, keep selling books? That’s your bread and butter if you’re doing retail arbitrage and want to switch to wholesale.

Don’t stop going to stores and buying stuff? That’s your bread and butter keep going doing retail arbitrage if you’re doing a wholesale want to do private label, don’t stop doing wholesale, get a few private label products and do both do all four yep can’t hurt. So any last words to wrap it up better yeah, it’s hustle o’clock, everyday hustle o’clock. You know wake up. I think the best way to operate for me personally is I just wake up ready to tackle the day.

It’s some days, I’m not ready to tackle the day, but I just reflect for a couple minutes on all the beautiful things half of my life and it makes coming to work it makes meeting with new people. It makes just being a presence in life with family friends, business relationships. It just makes all that that much easier, so really at the end of the day. It’s about my perception on life and and I change my perception and I changed my life.

Clever Fox Planner | First Impressions & Pen Test

It’s been a hot minute since I filmed a article, but I figured let’s start it out with a bang right. I am going to be doing an open box first impressions and pen test on a planner. That was sent to me, as always, a full disclosure. This company reached out to me and wanted to know if I wanted to take a peek at one of their planners and, I said sure I’ll take a peek at it.

I’ve looked at it a little bit, but I wanted to just go over it with you guys and just show you kind of some different things that are on the market. This company is clever Fox, and this is the clever Fox planner. This is an a5 size and it’s 5.8 inches by eight point: three inches it retails on Amazon for $ 24.99. It is available in prime and then there’s a black orange and pink version, and I got the black no surprise there right.

So anyway, you get it packaged very nicely. I took it out of the package already and then it comes in this nice little white box that has the little fox logo on there. It’s got some little. You know information about clever fox and then it’s got. You know information about how to set up your planner. If you want a guide, I know some people like guides. Some people like to do what they want to and then there are these as well, and it says, give this card to someone.

You love and it’s coupon codes, and it’s all the same. So if you want 10 % off of your order on Amazon, you can screenshot right there and you know apply that to your order. So I’ll leave links down below as well and then, when you open it up, you have three sticker sheets they’re, all the same, and so we’ve got like a little graph. Some people more people presents kind of a workout thing: Amil finances, love, reading and then kind of like a little yoga thing.

So anyway, I got three sticker sheets and then here is the planner. So let’s actually take it right out of here to move the box. Alright, so here is the planner and first impressions. I was actually with my mom when I got this because I stopped at my public mailbox with her and I was kind of taking out of the package and she felt it and she’s like oh, that feels so. Nice, if you guys, are familiar with the Erin Condren Bound notebooks, that’s what this feels like, I’m not sure, I’m actually on the Amazon right now on the Amazon yeah right now, and I’m looking to see if there’s any more information as to what this actually is.

Okay, I just kind of skim the description and I couldn’t figure out what this actually was, but it does feel kind of like a a leather like material, but it’s very smooth. It also has the embossed Foxx on it. I don’t know if you guys can see that it’s right here yeah. I think you can see it it’s hard to tell on the monitor if it’s going to show up in the article and then it has one of these little strappy guys, and then it comes with this.

You know little thing around it and then you know this comes off. There’s a little pen loop right here, which I think is really nice and then on the back. It just has some. You know information. So, let’s pull this off like dismantling it, because you know you got to do that so yeah I like how sleek this looks. You know it’s like something you could have like sit on your desk at the office and it wouldn’t be like that crazy.

Like I said they do come in other colors, so if you’re really colorful person, you can do that too and then um opening it up really nice front paper. This paper feels nice too. It’s very smooth paper and that just has like an information page and then goes into the planner. So the first page is my gratitude and self-awareness, and that says I’m grateful for what I’m passionate about and then my daily rituals skills to learn affirmations, and then it has a govision board on both sides and then my goals.

So there’s all these different things. So you got health business and career family/friends, significant other in romance of Finance, personal development, fun and recreation and spiritual, and then over here it has. My focus, then, has all these goals one through five and then my mind map with some graph paper. So you can draw – or you can just put some text in there whatever and then this comes unded.

So then you can just write in the month in year, so you can start it at any time which I think is kind of cool. And then you can write in you know what day it is, and then you can use your plan, your months goals, the months wins and then what you need to improve on, because we can all improve right so yeah. So then, let’s see here how many months do we have with one two three, four: five: six: seven: eight, nine, ten, okay, so they’re all our twelve months, so you can really start at any time or you can start at the beginning of the year.

Whatever you want, and then after that we have, it looks like weekly pages, so you got your Monday Tuesday, Wednesday, Thursday Friday and then Saturday Sunday are these smaller columns over here and then over. Here is kind of like a goals and lists page. It looks like so it says this week’s main goal: priorities, notes, to-do lists, habits and skills. Then it has a little tracker for all the days of the week and then the winds and what to improve on next week and then yeah you’ve got this basically for the bulk of the planner.

So that’s kind of nice so like depending on what day you’re at you can just go like this and you know know where you’re at and your planner right. So let’s pull this off again and then I wanted to show you guys this. I thought these were interesting, so these are little ribbons that are attached and obviously you can, you know, put one in one section and then you know put one in another section and so on and so forth.

So I think that’s kind of a nice thing. If you want to mark certain pages or know whatever you want to do things so yeah, I think it’s really customizable to be honest, and then let’s see okay, and then we get into a ton of graph paper. It looks like oh wow. The rest of it is all graph paper, well cool, all right. Well that sounds good and then what is this? Oh, this is neat all right, so this is like a little pocket.

Folder! Oh, is this? Where you put the stickers now, let’s see, did the stickers fit in here they’re tight, but they fit there. We go. I just needed to wiggle them in a little bit so yeah your stickers can fit back there. Obviously, you can put other stickers in there too, but I don’t know, I think it’s kind of neat and interesting, but yeah. It’s like very, very nice. I like the spine, a lot and yeah.

It feels just like that. Erin condren, like leather like material, I don’t think it’s leather just because of the price point to be honest but um you know I I like the feel of it. Also the paper is really nice. I mean I’m at a reference. Erin condren a lot because I have an Erin Condren planner, but um it’s not as nice as the Oh. What’s those inserts those crafting inserts? What are those called? I’m like totally brain farting, now a lot of people use them in wring bone planners.

I can’t think if I remember when I’m editing I’ll put it down below but um, it’s a very smooth paper and it’s a very thick paper, but it’s the Erin Condren one is a little bit more grippy if that makes sense – and this is a little bit More slippy, it’s like a good way to describe anything, but that’s the way. I know how to describe things so we’re just we’re just going to go with it. You guys so anyway, on the back page here.

I think what I’m going to do is I’m going to do a little pen testing for you guys and I’m going to do it over here, so we can zoom in a little bit more. I do apologize about the shadowing today. You guys it’s very, very dreary outside today, even though it’s not raining at all, but I wanted to do it with blue ink because I’ve been using blue ink lately and I don’t really know why. But we’re just going to go with it and I figured I would use a bunch of different types of markers and pens and then we would look at the other page and see if there was an a shadowing or anything like that popping through.

Because I know in the planner world that is a big deal and we like to know which pens to use if we like this planner. So, let’s get into the pen test all right, I’m going to zoom you guys in just a little bit and then I’m going to use some regular pens or not regular pens. I mean any regular pen would work, but I’m going to use some more gel pens and then also markers and things like that. So the first one up here is going to be the paper mate ink joy, gel pen in the 0.

7. This is the blue one. I do have a navy one as well and I’ll be testing both of them. Also, this is the jelly roll. The oh eight in the blue next up is the Paper Mate ink joy, gel pen in the 0.7 in the Navy, and then we’ve got the jelly roll. Oh eight in the Navy as well and then next up is the papermate Flair in the blue and then we’ve got the Erin Condren marker I’ll, do the fine point and then I’ll do the medium as well.

And then I have the lip pen. I don’t know what point this is, but I think they only come in the one style. I think I’m really not sure this is like really satisfying to write with. However, I’m just letting you know, and then we have got the micron. Oh three in the archival ink in the blue and then last but not least, this is the pilot ultrafine point permanent marker, but it’s feels more like a pen, but it is a permanent marker all right so now all of my blue things are done.

Let’s do a little test here. Okay, now you guys can see everything so anyway, um, probably the most satisfying to write with is the lip pen, but I do really like the way that the jelly rolls felt on this paper just FYI. I don’t know if that makes any difference to you guys, but let’s look at the back side and really the only one I see even the finest bit of shadowing on is the last one that I wrote with, and I know it might be hard to see On there, but it’s this one – and this is the only permanent marker well in that permanent marker.

But this is the one that has like the thickest stroke if you will um, but that’s the only one I can see that has even the finest bit of shadowing at all and it’s right here. To be honest, I can’t see anything else, especially if I put the page down sorry, I’m like a really zoomed in right now, if you put the page down, the only one you can see is that if you have the page up like this, just because there’s A light coming underneath here, you can see it a little bit more, but this is the only one I see, but you know what to be honest that wouldn’t really bother me.

If you like to write with these as well – and I have found – I don’t – have a blue sharpie fine point, but I have found that the Sharpie ultra fine points do about the same performance wise as the pilot on most papers. But don’t quote me on that, but if you’re into using markers like this, if that shadowing didn’t bother you, I think you definitely could use this planner, and this has the same paper all through the st.

All through the exact same planner, except for the first page. When you first open it, this front page is oh hold on. Let me zoom e all out again sorry about that, except for this front page is a little like really really thick. It’s like a card stock kind of paper where these are. You know more that silky thicker paper but yeah. That is what I wanted to share with you guys today. This is kind of a short and sweet little article, even though now my viewfinder is telling me I’ve blabbed on for 17 minutes, which you know is pretty accurate but but yeah.

I really. I think this is a cool planner, especially like on the go or in the office, or just like having something for like goal setting, and you know, keep your life a little bit more compartmentalised. If you don’t like a lot of freedom, this is definitely something that could possibly work for you. It will be quite a ride, prepared hundred slides in three main topics, so I will switch now to shared screen. So so we kick it off and the latest numbers came out and in Europe, Amazon announced a gross margin of 32 billion euros in Europe alone, and this is kind of I just would blow my mind, because this is kind of the scale will work talking now About – and this is not like because Corona they have an uplift – no it’s because they’re really focusing on digitally are really focusing on marketing they’re, really focusing on the client, and so I thought it’s kind of the good opener.

Yet you can realize and kind of what scare they’re thinking and what we have to think that as well, it’s kind of they’re making 10,000 bucks per second a second. I wish I would earn that money, but this is kind of the competitive landscape. You are working on, and this means they’re growing 200 million per day and that’s just the growth so they’re making nearly a billion per day, and for me it’s important to mention that, because, with that with this growth, a lot of change comes to everybody, who’s listening And reading now, every day, and so it’s not only kind of what we’re facing now in the corona environment, but also everyday, Oh everybody’s, working with Amazon knows that everything is changing, sometimes annoying, but we have to be open for that.

And so what we see with our clients, but also in the market, is that we see like two kind of steps which we need to avoid and the first one is you’re paralyzed, so nothing happens, Media blocked, don’t know what to do. Stores are closing now we’re getting in the next stage, where they opening up in some countries and others not nobody knows, and then we see a lot of people trying to really force it.

So yeah pushing media in it or trying to jump on the track and not really thinking through it with you in this webinar today, I think you’re, none of both, so we today going to discuss how we can analyze the situation and how you can then profit From that, but not only from the situation we arrive in now, because everything we’re doing and did in the past is now just going faster and quicker. So everything I would talk about today – it’s not only important for today, but also for everything you do end it in the past.

This is really about how you define your strategy on Amazon, how you get the most of the KPIs. What is really important right now in the times we have and what you have to check on regular base and maybe automate and then how we can scale that and measure it. So for me important as a start and how we kind of how Amazon works and what is important for us as a marketer. So really that Amazon is not only a ecommerce platform and we just talked about the scales.

32 billion in Europe did going into other services as well, and I like to highlight that, because we as a marketer can use the data, but also in areas where you think you’re safe, there’s a lot of change. So, for instance, the one which right now gets a boost and really kickstart is food online, so groceries online and it’s not only Amazon but all the other ones outside there as well getting a boost.

But it’s not amazon’s here going faster than others again. So when you look at array vivek in order or like some online they’re reinventing it and integrating their offline supermarkets, for instance in the u.S, integrate that together again in the seamless way so that you can do the pick up you can go in, you can even Go in and don’t pay for it with no cashews so pay for it. But do it online over your Amazon account and when you have the chance and go to New York or the yes, and you will see that everything is linked to your account.

And you have a lot of crime discounts here as well. So an integrated program, another example which right now gets boost is pharmacy. Where a lot of brand started one year ago would say they going on Amazon doing a little bit, but here again Amazon bored little startup called pill pack, which is now really big, which organized all the 50 pills you have to take when you’re over the age Of 60 and says, with you kind of one, you have to take what and link that to your Alexa, who reminds you, so this is kind of again where they not only think I’m in kind of how we have to ship this online now or we have A repertory city, but they rethinking how this whole structure works and to link this all together, and this is where it gets really creepy is their own insurance company, so they started their own health care insurance, which I think we’re now really pick up, especially in the Us and linked the distribution, the service and, in the end, the insurance behind it together, and this is important for me for the thinking of what we face as a marketer and how we have to think as well.

It’S not only ads on Amazon. It’S really. What can we do with his experience, and how can we use that? How can we use a twitch one of the biggest streaming platforms in the world, or how can we leverage the possibility that we can now run ads in Emma’s in music or in their in their streams? So it’s going beyond and not only the standard basic. What we do, maybe in the sales department, and then you go the next step, and this is definitely where we’re talking about marketing and not only we have an Amazon and we drive sales on Amazon.

It’S thinking. How do we reinvent that going into skill sets and combine that with the TV screens where Amazon integrate the Alexa thinking further about it? It’S where Amazon gets all the data round and they go and really in the IOT field. So Amazon owns the media blogs. I mean everybody’s – probably right now, looking Amazon, Prime, the the stats going like crazy on Prime Netflix, everything streaming this data again, we can use.

We have IOT with voice where they’re kind of at the forefront peddling against Google, who is the best set up in the end, because this is the look in effect again for the client. And with this we have a lot of data data data data, and this is where it’s getting really cool and we can use that data and today we’re going to talk about how we can use the data in a small package. So how can actually drive sales because, most of us, this is kind of our odds, responsibility newcomers drive sales, but also how we can scale that and Amazon is scaling it like crazy, so they’re now the 3rd biggest advertiser in the world and they just started a Few years back, and so it’s impressive scale, and to underline the importance here, the latest numbers – this is from a report from tribes – is 45 % of the market share in second half of 2019.

So last was in Germany on Amazon. That’S nearly half of the e-commerce! In Germany, in other markets is kind of the same. If you’re, looking at US or UK in more lower in Europe, it’s a little bit different and, what’s most importantly again, is the growth, so the e-commerce overall growth by 10 percent roughly depends on which study you trust, but M of them grow by 35 %. So they outgrew everything and they basically were responsible for the growth in e-commerce.

We have a few other players which are there and they are all marketplaces which drive the rows talking about Zalando going marketplaces or now an auto go into marketplaces so that we see this whole shift. Everything goes in the in the growth goes on the market prices and not the small stores. So this is even without a corona effect, and this is where we have to face and to think about how we work and with our strategies.

And it doesn’t mean that we don’t only have to work the marketplaces. But it has to work long and has to work together so for Amazon, it’s still day, one I’d like to say it: it’s not only shop. Amazon is really an infrastructure of retail, and it’s even more. It’S not only logistics, its its media, its servers, its kind of a part of the the distribution internet. I would say so it’s an interest in interest and what we saw in all over Europe.

It’S a critical infrastructure in times like these, if you think about, if you wouldn’t have had or still don’t have the working ecommerce, we would have had some really big problem or the course of the last two years at two weeks for three weeks. So it’s right now really easy to get on Amazon, but – and this is the part of the hard part – this chef space unlimited. So it’s not! I go in the supermarket and I talk to the cue card manager and show to the supermarket.

I hey. I won’t have to search you get five thousand bucks for me. If I can put my my parts here, it’s the end more complicated on Amazon. They give the opportunity to do that, but you have to do it on your own and it’s not because I like you that you get the stretch. No, it’s all based on numbers, and this is where we dive in because they’re not focusing on b2b they’re, not focusing on you as a brand or manufacturer or seller or reseller they’re, really focusing on the customer.

And this is often annoying for us because they didn’t really care about us, because if they both won’t buy my vacuum cleaner, they will buy vacuum cleaner of another brand, which has the best rating the best stars and the best price. So this is kind of the. Why it’s so tough right now and Amazon just can say: hey we have enough stock right now we won’t take any more stock of of your products. So this is the hard part.

Amazon doesn’t really care. What your part is also really good chance, because, if you’re an underdog or you’re, not the number one brand, who normally I wouldn’t have a chance, you can now dive into it with the right set up to really drive that. I would tap today into a few challenges of yours and focusing really on the advertising parts, and this is if you’re, in the operations of advertising. You know it’s often like most of the times.

You don’t have enough time. You have to take care of everything that Amazon or you have like five other clients which you have to serve, and you have a portfolio which is maybe over a hundred products, and why? How should I manage this? How do I set up campaigns every week? Something is different, and now years is talking about DS P. What is that, and so this whole struggle around it if you feel kind of the same year, if you kind of how should I handle it or how can I get on the next level because the CPC is rising or my a costs? Advertising cost of sale is yeah, it’s rising.

What should I do, and I want to give you a few steps here. Of course, we can’t handle everything in this few minutes, but I want to dive into three challenges. The first challenge is, you have to get rid of all the building and pacing stuff so that you can really focus on strategy and tactics. So I will focus on this part. Pictures is really important for you and to define the right check, ticks and strategies, but also know how to get rid of the basic work here.

The second challenge: how to scale that and make it performance oriented so that you drive incremental sales and not only you have a nice-looking return, elaborate izing spent, but in the end you’re targeting clients who would already have bought the product. And then the third challenge is the advertising and retail cam. Ok, guys to combine that, because it’s nice that you’re the return, elaborate iseman, looks good.

But in the end, if you yeah, you sell under your margin or you have the problem that your campaigns advertise for another seller, because you have a lost by box issue or you’re out of stock or you will run out of stock. So the combination is really important and I cluster that in three different sections and for each section I want to dive into it. But first maybe step back, because I want to stress that I can understand the feeling that there’s too much work right now.

In kind of – and you have to less time so when I started with fact I four years ago, I we were kind of five people and I had to manage really fast 15 accounts and with that over 5,000 days, and I was like what the how should I do that, so I really focused on a few things, which I think it’s are crucial if you grow and how you can get more efficient, which I want to share them with you in the next ya minutes.

It’S really kind of what a painful way for me, and I want to save you, maybe one or two years of these, so how to get to the step to grow you and scale your business and you account, and I think the tricky the most important part Is automation so don’t do any everything twice or three times try to automate it? Second, one is really focus in terms of growth in certain attachment and use these P when it’s make sense and look at the account holistically, and this is kind of how we could grow.

Then, after two years, 250 people and grow the business with that, and I’m quite sure – and this is kind of what we did like. The other way – is kind of refocusing on again automation, automation, but also thinking around the corner. And what really were to really push the buttons? And what not? It’S that? Where we are really where we are right now and we’re really proud of we’re over hundred thirty specialists in eleven age nationalities, because we serve all countries around the globe.

So in native speakers, important notice here, please use native speakers. If you go to Japan for instance, and don’t try to use Google Translate yeah. I can give you some insights because we are managing over eight digits of media budget and have over billion in sellout on the management. So we can see quite some trends. I would say, and this all over works for 250 brands and yeah, even though I’m now managing director it’s for me, it’s still really love working in on account, and I really love to dive into to think kind of.

Where does it go um? So, for me, the core values go ahead and discover and learn a teacher of the most important ones here so be on the cutting edge. And then it’s important also that you’re quickly enough to cope. So we can do five thousand set up all over Europe, but also its small enough to care so that we work with smaller brands and smaller manufacturers as well, who have maybe only three products and just to turn around or 50,000.

So this kind of short, why? I do this and why I do this, maybe now, because I think it’s for everybody important to know that it’s not like this, it’s crazy and let’s pick what you have to only know, but there’s a way to get there, and so I will start with the Kind of basic in two minutes: this is kind of what you see that Verizon Amazon, so you have like spun up brand on top of years from the products.

Those are the few parts, that’s when a basic, so everybody’s aligned. Here then we have. This was on the search page. We have on the normal product detail page. We have advertising as well, which is under the pie box, which is the box here. We have an advertisement for Emma’s and basics so for Amazon’s own products, and we have underneath all the products as well. So basically Amazon’s stuff with advertisement works on the one side.

Annoying because you have to pay a lot of traffic on the other side, really cool, because you can really navigate where you want to go. It may be here. The first Corona related part. Amazon kicked all bought together, free creeks and DVDs to reduce the traffic and the weight on the business. So what they’re doing right now is all over Amazon. You see little different changes so, for instance, in this one is gone or the deal pages are gone and we have less of these twisters here, like all these bars, where we have the advertisement so a lot of changes behind the scenes.

I will dive into that later, if you from the s who maybe have seen something like this, so your article ads so us often had like, has like one year advance, maybe half a year advance different spawn of possibilities. So it’s always interesting to read. What’S happening? Yes, because if it works, it will come over to Europe, but and then we dive into the first challenge here is really: how can I get really focus on and it doesn’t matter if it’s a banner on top or the below or somewhere there? First of all, we have to set up the right strategy and the ride goes, and then this data mines, kind of what of assets you use from Amazon or what products you use.

So the first thing is setting up the right goals and it doesn’t work in email anymore to have one rose goal here and I will dive into the topic now. Let me once again reach check if everything is working right now, if everybody sees everything. Okay, no comments here so okay, so I would dive into this topic here so setting the right goals, most important messages. You can do with everything, with a mother more or less everything.

So it’s not only to push your advertisement for the next month to push your M to push your sales for the next month. It’S also to really think in a global annalistic way. So what you can do is, for instance, you can push your brand awareness this. The easiest talking with the media guys, but you can do into cross selling you can do an app selling. You can focus on really driving only incremental, say it’s.

You can dive into pushing your organic rankings, which is for me most of the time, the most important one, and I have two examples for this. One is the product launch, which is most of the time, the most crucial one to use advertising to do it right and to really focus on the roots right kpi’s. So this is an example from set of five smoke detectors. We did, and I have it in every presentation, because it’s the most important message here is Amazon.

If you bid on a keyword, for instance, smoke detector and you somebody clicks on your product and buys your product, your organic ranking goes up. There are few other factors like margin, but this is kind of the basic principle. How well you click the rate, so people click on the product and your sales on the product on the specific keyword is the cool part. Is Amazon, more or less doesn’t care? If the click is organic so on, if you pay for it or haven’t paid for it, so if you now put an ad on smoke detectors and you product this right now on page seven hundred thousand pickers, there are hundreds of smoke, detectors and click.

On the add your, and so you have a good picture rate, because the ad is fitting and the people brought the product, your organic ranking goes up, and this is what we see here. So at the beginning, we put AB lot of put a lot of made a lot of sales wire advertisement. So you see at the beginning the chair here so 30,000 40,000 of sales, only with advertisement and then afterwards, overtime, because organic rankings went higher organic salesman and this is basically the principle of every product launch and you have to think about that at the beginning.

You’Re not visible, so you have to really focus and using ads in the right way, and that could mean that at the beginning, because you have less star rating, you don’t have the nicest yeah content already you don’t have so much trust. Nobody maybe knows your brand. That you’re a costs, advertising cost of sales, which means costs divided by sales. It’S maybe not that good, so maybe 60 %, so you don’t have a break-even here.

Maybe your breakeven is here with 10 % and at the beginning this is not that important, because our focus is not on the a course. The a course is there for optimization purpose, but the focus is on. How well does my organic ranking goes up, so my ranking improvement is my main KPI here, which you have to measure which Amazon doesn’t give us out-of-the-box solution. You have to measure on your own or use a tool for it, but this is for me the most important KPI on that face, because afterwards, when you’re on the first listing position, second or third, then you get the seeds because people click on the first positions.

We learned that from Google we learn that the best on top of the list for every best seller list, the top is the best, and this is what we buy, especially if it’s such a product. Another example – and this is where it’s gets more sophisticated and if you’re kind of already in the game, it’s how do we get incremental sales and the basic setup is in this may be a little tricky slide, but the key takeaway years, if you bid on your Own brand, the the percentage of people who wouldn’t have bought the product anyway is really low.

To be honest, if somebody is looking for a Dyson vacuum cleaner and it’s pretty sure they want to buy it if they are looking for it, so my incremental factor is not that high, so we often multiply the returner effort ions, and so there was with an Incremental factor, which then would be maybe only 5 %, because we assume that only 5 % of the people would have bought another product. But in this important part here, if somebody else it’s on the Dyson and maybe it’s an AG or Porsche Siemens – and this is product which has five stars as well – cost half of it – they might steal some of that sales, and maybe you don’t want to be Compared to them, because in the store you’re going a different corner, I have another presentation, so you use those brand keywords to show your highlights to protect that other competitors are not bidding on these keywords and link them to your maybe to brainstorm so protect your brand And do a cross and upselling, maybe on the other way around, we could bid on competitors as well, but to be really honest here on Amazon.

This is with search advertising really tricky because, as I mentioned, the click-through rate is important factor and if you click, the rate is really low. Your bits needs to be higher so often bidding on a competitor. Doesn’T work really well, it’s really expensive and you have low traffic because your click-through rate on is really low. But of course, if you want to gain market share – and you don’t have your own traffic, this is a valid option.

So most of the music is in the generic keyword field and for me, the most important field as well, because with that you again, you can push your organic rankings, and this is the field where it’s actually interesting. What is my incremental factory as well? So really focus on if I’m already visible on vacuum-cleaner cable s and I’m on the first position, I already will reduce a lot of sales Organic wise on this first position.

So my incremental effect on that keyword is not that high. If I look on vacuum cleaner in red on that keyword and I’m not there visible on the first page, then I’m putting in my ad ok means you’re 100 % visible now before that you weren’t visible, so there was no sale if you’re, not in the store. If you’re, not in the, if you’re going to supermarket and you’re, not anywhere to find maybe in the last corner at the top right shelf, and then nobody will buy you.

So if you do a net and you’re kind of directly at the counter, you’re doing the cell or Mahseer, so it’s a directly increment effect, so important part is to really measure if your organic, visible or if you’re not – and this is the next step here so For everybody who’s like already in the game for two or three years or knows how it’s going on because they did Google Ads Google Shopping ads. This is kind of where it’s getting tricky and where you get really getting into Drive incremental sales and the rule of a thumb when you’re not able to measure the organic ranking because you’re missing the tools is something I would always in the incremental impact.

Think about what is your general market share right now, because this is a good measurement. If you already have a market share on Amazon, maybe 20 % and on generic keywords, then you maybe your incremental factor is 20 % less. So this works as well as a rule of thumb, but this is where we dive into. I know this is really really complex and if you kind of think what the hell is new, it’s talking about feel free to reach out to me setting up a call and we can discuss it for me – important takeaway.

Here’S please set your right strategy, set your right goals and then we define the KPIs, because for each strategy we have different KPIs and with these KPIs you have to measure the success of your campaign, because when I go back to slides, if I’m only looking at My I’m running animals, an automated campaign, put all my products in there or the keywords together if it’s a brand keyword. Of course, yours is better because if I’m looking for again my working cleaner and somebody’s looking for it, it has a really nice return on effort.

I’Ll spend put one euro in get hundred bucks out, but in the end I don’t do more sales. If I compare two generic where maybe I have to put five bucks in the number looks way worse, but in the end and doing more sales. So this is really important to check it. There’S more your homework. Everything here is also explained in our weight white papers on the website. So it’s like really yeah. Somebody hated me for these speakers to say, like it’s like doing a you’re marketing class at university, but it’s really kind of how it works.

It’S not Mac. It’S not blah blah. It’S really how you can set it up. So when you then think okay setup is done and you’re done, it’s no! No, no! No! No and it’s even more critical now with the Corona effects, because we not only have different life cycles, for instance right now, we have like at the beginning of the crisis or the fitness gear. What you could do indoor was exploring normal. This is something for winter, and this life cycle is important as well, because traffic changes with this budget changes and also the the product itself changes.

So we have seasons, but we have also product life cycles. Then we have a lot of right now, and this is the most important part here: stock and buy books tissues so, for instance, Amazon right now is not shipping in France, any goods other than essential goods by themselves, so they’re moving to F p.M. So for food By merchants, so you really have to check your stock and buy books and, of course, over time they will put for you to changes.

We have like new options for ads and the people are looking in a different way, so moving from desktop search to mobile search and what we have right now in everybody working back home, we see a rise of Facebook of all the networks. Right now have a lot of desktop searches as well and on Amazon as well. I assume because we can’t measure it but because the people sitting at home nobody’s looking over the back and it shifted from mobile to desktop again.

So it’s really interesting what’s happening there and what you have to think about and for me really really important – and this is always when you think wow has real awesome campaign most of the time. It’S not because your bit strategy is the best because you will get on a certain level. It’S really because something’s changed with your price. So often, if you have a discount on it or maybe Media Markt or see discounts change, the price Amazon is matching it and your price.

Louis then, with that o for for a second, you have a really good campaign running and because of all those factors, you have to measure that as well, and this is where you have to work together with your account manager with the Amazon you Khmers responsible person And on the other side, as a responsible person for e-commerce, you have to talk to your marketing people, because if they don’t know that you have out of stock problems or right now in China, the effectors are shut down and you will have a delay of two Months so they should stop their campaigns and then you have an issue, so we use it with our factory suite where you can see actually kind of where you have problems and issues on a on a continuous pace and for me important – and this is one of The takeaways here, if you have a software like this or not, and if you can set rules like this or not, you have to write now check, and this is the first thing you have to do when you’re getting off.

This is in your campaigns. We have a lot of products right now which have a really long shipping window. What does it mean? This means that your conversion goes down with this. Your return will go down on the clicks, because the clicks cost the same most of the times. What we see so your maybe your margin is threatened and you have to react and also, if even if your products are right now low on stock or out of stock, we run into the issue that you, the campaigns, still keep running so, for instance, upon the Brand’S, the campaign we run Amazon doesn’t care if you’re in the buy box or somebody else’s in the Bible.

So you have to act on that. That’S why we integrated that in our software. But if you don’t have something like this, please please check it on a regular base. Otherwise you’re just burning money. So saying you can’t really check everything right now with this, and I have a few example from the current state where we are that AI is maybe not the solution for everything I mean it’s a cool password.

We use machine learning for a lot of stuff, but for only bidding it’s a little bit critical and I have a few examples, see how you can read those graphs from different clients, and so we dive into the numbers a little bit. So what we see here is actually when over the course of the month, so we have the month on the bottom. They start in 2016 and you can see that in in April there clicks went really down.

So we kind of have more or less no clicks left compared to the time before and the a cost went up so we see now we can assume a lot of things. One is mm, maybe the bits were not are high enough. Some competitor went in so we won’t get the placement or it can be. We are out of stock, we lost the buy box. That’S why de-spawn the products weren’t displayed anymore. There can be a lot of reasons behind that where you have to link and talk to your retail team again or look into your cell at County, so this graph here is not only enough, but we see a change here in the second graph underneath here we See: okay: this is over the course of a month really cool with Corona.

We see a really nice click-through rate, so you could assume that we have like done everything right in terms of pointing to the right triggers, but what actually changed here? Amazon, this ticked some of the red placements out of from the website so that they are right now only better placements left above the fold, so the click-through rate over all accounts in general, went up which is really cool.

But – and this is the really cool part here, starting of April – the the impressions went through the roof, so this is obviously a product where a lot of people looking for and where we see more, where we can dive into so again. It can be different reasons where you have to then dive to again two more examples. Just to point that out. We have here an example where we see the click-through rate again going up, but overall, our operations going down.

So in this case it’s a fashion client. So the people are looking less for those products right now we see as a hint. We see that it’s going up again. So just the first estimate, but the quickly right here again had Marla that’s nothing to do with kind of a better at place, but what we did in the bidding. It was really a change of system and one last important information here. They prime, they will be moved.

We don’t know where and if at all. But if you see the impact here and don’t be afraid of the side numbers here in the millions. But this is really the impact of Prime Day, which is a cyber week which is done decently, so having the right setup in terms of deals pointing the right products. They are doing their advertising strategy with this together and you can see in the day they’re doing more sales than maybe one or two months.

So this is a really critical factor. I’M really curious what’s happening here. What Amazon does with it, because it’s for them the most important day to push their devices in the market? So, let’s see as a key takeaway. Please please please talk to each other if you’re responsible for the content in your product team or you have to do it on your own, that’s the first thing. You have to do to drive your conversion rate, but of course, if something is changing, maybe the seasons changing and right now we have like getting a lot of bad reviews.

Review management is important, so all this parts getting and playing together. So when I’m talking only about Emma’s an advertisement, this means you have to get your retail data right and you have to get your conversion later right as well, because this is a lot of crazy stuff as well. They on the start page, they have only digital products right now, so everything you would see right now on Amazon is really they’re trying to avoid that the people buy more when we talk to our clients um most of them, especially in their essential goods. They have like every day a primary and in categories which are beside that we have 50 % growth, 60 % groves. So if you’re not growing right now or you’re, not having stock issues, then something is probably wrong with your visibility, even though Amazon is trying to get rid of, everybody was kind of thinking only buying something only serving people who want to buy something.

So the main ideas right now really focusing on those people and who need stuff so far as it’s a chance, because we can now use their framework right now and besides all the noise which we normally have can work. So we can work in the whole funnel here, which is often a web, so from create awareness and purchases, and this is where what you see when Amazon account executive will knock at your door.

If you big enough, they will talk about what cool things you can do and most of its really cool, but you again have to really think about what is my goal. So you can book the star page if you’re crazy enriched, but you can also do more sophisticated things than doing a pro credit programmatic advertisement, which means using Amazon, stated target the right person. So you sitting in front of your laptop, they know.

Ok, neots is somebody who’s already always buying more expensive products is right now in the category looking for vacuum, cleaner and he lives in Cologne in a in not not Civic apartment, but he’s like right now looking for the product and we can show the yet so Really target it down, but of course it’s not only boring ads anymore. It’S also really cool stuff, which you can do, for instance, especially with article, and we see some really nice numbers here so in terms of awareness, which means they are, they measure, often in kind of first it more important, KPIs kind of cost per Mille.

So how much you pay for to reach the thousand people, but also kind of then in article completion rate, which is then the most important or cost per article completion, and here Amazon can definitely fight against the YouTube or Facebook, especially in terms of quality. So when you want to test this and you’re thinking about doing it even like to drive your sales, I what during mobile article ads, which are doing really well in terms of return and advertising spent.

So we sometimes see like rows of five or four with these ads, even though it’s an awareness, part and also and of course, which is coming now, is that you can dive into the voice part. So if you have something, if you want to do advertisement in Emma’s music or if you right now, everybody’s looking in the fire TV, the the numbers are rising like crazy. You can do sponsorships or everything around that.

But again we want to scale it, and this is the important part with this. The Larry Page has to work together. So when I using an app, this is the net. Nobody sees it. This is the kind of day at how we could do it, but you can also use Amazon enas and for me, it’s important here create the perfect landing page for this as well, and this is the takeaway here is: please focus on the focus on the right Landing page here as well – and you can build your own landing pages now – it’s not like two years ago, where Amazon oMG had to build them, for you can use Amazon stores.

So if you’re going log into your advertising central, you can build your own stores and you can build your own portfolio. Please, please, please don’t show there your whole everything you do build sub planning pages, which are fitting to your campaigns, and I put like a really new image in here now you can do even overlays, so they’re, getting better better every day where you can directly buy On the other pictures, you can build your own, create your own world around this one step back from the landing page, so landing page has to fit through the credit take away here.

You can even go crazier, so you can use those landing pages and create with all Emma’s on a whole, funnel approach. I won’t dive too into this today. It’S just it’s a whole other webinar and it’s really on the management. Slider looks really easy, but in the end, in the technical part, is not that easy. But to give the you the outlook here, it’s possible, you can link an Instagram or Google campaign to Amazon, but what we often uses like your own store as a as a focus, because why sending traffic to Amazon? If you pay the traffic so send it to your own store, if it’s possible, but yen, re-engaging with them or filling the whole funnel with Amazon together again other different topic.

If you’re cussing about it, please ask me, then we can dive into it and don’t fall for the fact that it’s maybe easy and in the store amazon tells you that you can measure traffic. The most important part is, if you send traffic from the facebook browser or linkedin browser to amazon. The mobile browser won’t accept cookies. So, like you can’t track kind of the sales. So when you look into your stats, which are behind those stores and see like okay, what’s going on and you will see more or less no conversion – and this is basically a technical problem – which kind of is the big problem here.

So it’s possible but really tricky. So I would really really recommend you use what Emmas on offers you, and this is besides the search advertising doing advertisement on amazon effort, enemas on, but also outside of amazon and with their own funnel system, which is the smaller brands. One important fun fact here before we dive into how you can actually do it is normally on its amazon biggest client, so 1 billion roughly, I would say they doing in ads on at Google right now that change – and this is really cool chance Emerson, stopped all Ads on Google all ads on Facebook, all the retargeting, all automated marketing, there’s no right now: advertising on price comparison pages.

They drop the affiliate rates again and all the deep pages offline. So, basically, all the automatic marketing you pay as a vendor is offline and for everybody else, the whole retargeting part – and this is especially crucial if you have very expensive product or if you have a product with high involvement where you have to think about its offline. So the main conversion driver and to drive in to your sales is right now offline.

So if you’re, not in a category which has a high demand right now anyway, and where the people buy it on the first glimpse, so they know. Okay, I need a six-pack of water. Yes, people buy a six-pack of water online, they click on it’ll buy it, but it’s maybe the vacuum cleaner. But if we think twice about it, there’s right now, no retargeting and odd. Every marketer knows retargeting works, so we, this is definitely the time and point where you have to dive into right now to look at this as a funnel approach again so people on the top don’t know what we want.

They know they run, they loft run. They don’t know they may be. Wan na have a measure that track the time they run and rather run. They can use their phone, but maybe read so we have to create awareness. This is really top of the fun. You explain them. We have the nicest read which can track the time, and everything is included with this. Amazon gives you all the plenty of options where you can target people who are in that category right now, looking for product, but also on top of that kind of knowing that this, maybe it’s somebody who’s a football fan.

Because for me it’s if the code where I live so then you can target those ads together. So you can use this as well as you, but for us most of the time we start at the bottom of the funnel, because we do go to do sales and this most of the time budget is limited. We start at the bottom, and this is really combining here search advertisement. So when you go on the Sun or on beauty or somewhere else, they basically know. Okay, it’s you. It’S needs, and I will show you this advertisement, and this is what we can do here and the nice and the crazy part is. We cannot only do retargeting or quiets, but we also can do retargeting on similar ads so similar products, which means that, for instance, if I again back to my example and have my vacuum cleaner and somebody’s like now on a AG electron Karina and I spot Siemens Or Phillips can advertise those people, so I can directly target my competitor.

My competitor pool of people who have been on the similar product haven’t bought yet, but yeah are in the position of pipe and I can target them and the cool part is, and the yeah a little bit tricky part. So is that the competitor? Doesn’T he realize that so I’m not getting in a bidding war like on such a Iseman? I can really push them here, so the combination of postman is big and keeps it growing without investing more and more time.

So this is really where you can scale it. One example here what we did right now in the in the times like this, you couldn’t mean like okay, right now or the fitness studios are closed. We see a huge drop in the category right now, with protein shakes and everything around and with vitamins. It’S tricky. So we thought about a way how you can actually do that in a way not too pushy, but also how you can build that together.

But we thought kind of how we can use this in another way, and this is where you have to bit get a little bit creative. Yes, but if you’re shopping on looking for Google for product, it doesn’t really mean you wan na buy and normally, if you’re looking on Google for product, you will end up on Amazon any way, because the first ranking factor the first SEO optimized traffic is Amazon and Most of the time, the ads as well, so it’s a little bit different here in kind of what information you have first party data – and I already talked about the different – how you can actually target those, but it’s important they thinking about behavioral targeting and not demographic And this is often the fighty of internally when you’re talking to classic trained marketing people.

Thinking about okay, I need to reach in my target group. This is my target group which I set by location, gender or whatever, and Amazon really thinks in a different way. Why you NEED an LLC for Amazon FBA

I have to share this with you guys. So, like always in my articles, I do the Y house and then the additionals, so here’s the Y right – and this might be obvious to some of you – maybe some of you – it won’t be.

It is deductions. Deductions are crazy. This is how even fortune 500 companies are able to operate a loss and not have to pay taxes, sometimes even end up with refunds, which is insane you need to take advantage of that if you’re in the u.S I’m in talking to US law, it’s it’s. It’S really really cool in regards to ecommerce. What we’re doing in Amazon, it’s up to $ 5,000 startup cost. That’S so much money, guys $ 5,000! Think of the all the equipment you need.

You need an iPhone or an Android phone right. You need a smart phone. You need a computer, so all that cost can be deducted from the startup cost. Here’S the cool thing. I know if you just start it now or maybe a couple months ago, anything you’ve purchased in the year of 2017. Let’S say because you know we’re coming up on the tax season, you can deduct so that computer you bought in March. It’S now a company computer.

So if you have the invoice for it, you can deduct it. So you can add up $ 5,000 pretty quickly um. So expenses are anything from from defer. Your deductions are anything from marketing advertising travel. So, like you know, flights or mileage if you’re driving in a car the electricity bill right, everyone has an electricity bill, the internet bill. You cannot do e-commerce without internet. That’S a deduction seminars, classes, accounting costs even so much as meals.

So if you’re meeting say you and a buddy are doing the Amazon, FBA and you’re meeting them and you’re brainstorming, that’s a business meeting right! You can deduct it! Here’S another! Here’S! Another big wine paper loss right. I was mentioning that earlier, so you can actually operate at a loss and that loss of your LLC will compensate for your income tax that you have in your day job. So let’s say you made fifty thousand dollars in your day.

Job and you operate your LLC at a ten thousand dollar loss, keep in mind, we’re not in the business of losing money, but let’s say you’ve lost ten thousand dollars that ten thousand dollars in taxes. You can use the $ 10,000 that you’ve lost in your business. Can be used against your personal income, so you pay less taxes either way right. Here’S the how the boring part right, the very first thing.

Once you form you LLC, you need to put a corporate structure in place, so what that is essentially is you’re going to be paying yourself a salary. The next thing that comes – and I believe this has to be done within 75 days. It’S called an ECE. It’S an entity classification election. Now I don’t know all the details about it, but I can tell you needs to be done within 75 days and what it is is you’re letting the IRS know how you want to be taxed.

If you do not do this as an LLC, they will basically just decide to tax you at the highest rate, which is, I believe, as an individual and that’s a tax rate up to 15 percent. You don’t want that. You want the lowest possible rate. The help right this is this is really boring, we’re not in the tax business, at least I’m not. This is where you get help. I did it with 100 accountants. I would highly recommend them.

They set things up for you, they’re very personal, and you work with a team, so you’re working with a team, so you’re always going to be working with the same people. The people will already know about your expenses. They will go through your if you’re starting now they will go through 2017 credit card statements, alongside with you, and make sure that you’re getting the solid deductions remember they’re working for you.

Their best interest is to provide you with good service, so your remain on them. On the you know, on their payroll, your remain as a customer I mean, and and basically save you money, so the cost for that is about two to three thousand dollars annually. I know that’s a lot they do. You can split that up in payment. They do let you do that and then there’s a 30 dollar retainer. Now don’t freak out guys.

I know that’s a lot of money and that might not be the first thing you want to think of doing, but consider it as you know, as a cost to starting your first. You know your first product really right. You know you’re putting in such a financial commitment you’re going to drive yourself to success. Anyways right. It’S it’s another big thing. You know having no plan B, it’s it’s it’s a big thing, sometimes just jumping with both feet in and yeah it’s and then at it’s.

Just the 30 to 30 dollar cost. The cool thing is: if you need any so articles consultation, they don’t have any hourly fees. You just set up an appointment and you just talk to them. It’S it’s no problem, so there’s no hidden cost. Here’S the crazy thing on top of that we’re talking about deductions earlier right, you can deduct that. So essentially it’s done for you for free, it’s already a tax saving.

Not only will they do your personal business, you you Peart, they will do your business tax and they will do your personal tax. So if you’re already paying someone for your personal tax, you can scratch that right off you’re going to get that done with them anyways. If you sell on Amazon, you know that dealing with Amazon seller support is a nightmare. They are incompetent, they are foolish, they don’t want to help, but because we got to play by their rules by Bezos in his gosh-darn unfair system. Did I make money on? We got ta do what they say and we got a fine tips to get around all this nonsense.

So here’s a few tips that I do the first overall tip is to bookmark seller support on your computer when you go through on the desktop. It’S like. Oh, have you answered our questions yet and they want you to fill in this stupid like automated FAQ flow? Were you like? Have you selected these articles to read like yeah? No, I know what the rules are Jeff. I know how to work this game bookmark. The page, you can totally circumvent that and you go to this other page where it has all your options.

It’S like FBA issues or account issues or make a suggestion if you’re feeling feeling kind, but I bookmark that page right here. It just says contact social support. So I can just click there and go to it. The second thing I do is I mean after having telling you that bookmark it I wait like a week. I always wait as long as I can. You know until I’m going to forget it or until I’m doing like a badge of reimbursements, that I want to do because it takes Amazon like 45 days, sometimes to get a refund, and I would rather wait for the money then spend five hours a day.

Complaining with someone across the world, but it just is frustrating and doesn’t really help. The third thing that I do to kind of work with this with this torturous system of customer service seller service, whatever it is seller support, is to call them if you’re. Like me, you absolutely despise talking to strangers who know nothing just I can stop right there, but on the phone you hate that, and so you hate phone calls with people who obviously are just reading off of a script.

It’S uh: it’s frustrating to know that someone does not give a about you, but only when they say they do like I’m fine, I’m like sorry. I can’t do anything, I’m an idiot who makes $ 3 an hour reading off cue cards. Okay, I can deal with them, but just don’t be like. Oh sorry, we’re trying to best support you and then, when you ask them a question they can so they go okay and then go on to their next talking point.

It’S so so frustrating so when I call I say, listen, I know you can’t help me. It’S not your fault. Give me your supervisor and that’s like a really shitty move because of things of like oh you’re, like some suburban mom. Let me tell you this: getting a cold chick-fil-a sandwich and someone taking two grand from me. Those are two different levels and I think it warrants talking to a supervisor. If you owe me $ 2,000, is that crazy in my wild? To my out of my mind? No, I’m not I just like getting my money, so I sake I talk to a supervisor, they say oh we’re busy and they call you back like the same day or the next day, and almost always those supervisors are are really helpful because they actually are our Capable of independent thought, the fourth tip always keep these.

This is like the return slip that I got in the box of one of these boxes. You see back here. I got a bunch of returns a day because I get them on the middle of the month. They’Re actually from the 10th, but whatever there’s no point these. This has the item name, it has the FN SKU and it has everything important that they’re going to ask you they’re going to say: okay, do you have the shipment ID? Do you have the order ID? The order ID isn’t actually on here, but you can easily find that by going into your orders and just typing in the FNS Q, which is going to be this number right here, it begins with the X and then a few zeros whoops.

You have any pictures boy. Do I have pictures because I got a phone win so whenever I get these returns and they’re damaged I’ll show you what happened? I’M just going to show you pause.

I sold this. It’S a Sony DVD CD player, whatever that’s and the point. Look at that. It’S broken in the corner, it’s broken in the corner. Do you know how that happens? It happens from some goddamn moron and Amazon FBA fulfillment center, putting like one thing of an air pack or like two inches of a void filler in the box, and so it slides around the box smashes the quarter and it breaks that’s how this happens and the Only person who will believe you is a supervisor crazy.

Isn’T that crazy, but that’s how Amazon works and you just have to be. You know, reading people like me who get upset learning all this and then uh. You know you can do it yourself and just do all these steps. To recap: wait! Bookmark, seller support. Have them call you or call them well, they’re, going to call you back. That’S what’s good! That’S how it goes. You give me phone number. They call you back because they don’t want you having their phone number.

They call you ask for a supervisor. What they’re going to do then, is open. The case you go to the case on your view case page, you upload pictures to that. That’S how it works. I mean they’d, explain it to you, but it takes them three hours. Probably so I’ll just tell you right now, straightforward upload pictures and at that point you’re just in their their hands. You know it’s um. Are they going to believe you and believe in common sense, or are they going to screw over and try and get 80 bucks out of you or whatever? It is for this I mean, there’s way way way more items in just this – that I have that have been damaged over the past two weeks but hard doing business.

Everything has its ups and downs, everything has trials and tribulations and the people who can successfully navigate those they’re, the ones who end up making money and you want to make money. Amazon Seller Lawyer CJ Rosenbaum Q&A, Suspensions, Bans, Private Label, Wholesale, Retail Arbitrage

You are in Amazon lawyer or a lawyer who specializes in selling on Amazon. So why don’t you just tell us a little bit about yourself how you got started and what exactly it is that you do okay. Well, I have always represented entrepreneurs, even when I was still in law school. I started representing fraternity, brothers and other people who are buying and selling businesses and then, when I graduated law school, I always had a bunch of entrepreneurs as clients of mine that we would do all sorts of transactions.

But I spent the vast majority of my time for a good 10 to 15 years being a trial lawyer like I was the guy in court, convincing juries that my side was right. The other side was wrong and then I guess roughly eight nine years ago one of my clients started looking at buying an Amazon based business and I was involved in the contract and then I was in’then and I was involved in any closed and within a couple Of weeks with several hundreds of thousands of dollars on the line, his account gets suspended, he reaches out to me not so much for help cuz.

I didn’t really know anything about Amazon at the time, but to let me know that there was a lack of professionalism, a lack of lawyers who could help people with their Amazon issues, and they they were really the sellers, we’re really getting hurt. So I looked into the research and I started seeing who was out there and at the time there were two people. One guy was doing it part-time. Who was a former Amazon guy and another was a woman who was still selling so the confidentiality of people telling her what what they were doing? I was a problem and she was never like a big-time seller.

She kind of in my pink aina lacked the the ability to interact on a higher level with corporate people and significant businesses. You have millions of dollars on the line. Also. She was farming out a lot of work to people in the Philippines, so I thought it was a great opportunity, just like an entrepreneur, just like you and just like all your listeners and I spent about a year reading and studying and learning and going to Amazon Events and then we launched and now from then to now, we’ve grown to.

Basically, you know me and one website guy, I think, we’re up to 26 people 22 here in New York, 3 in Shenzhen, China, one in Evo and Hangzhou China and a full-time lawyer in Europe, and the entire focus of practice is helping Amazon sellers about 50 %. Has nothing to do with the law? 50 % is just writing. Plans of action for sellers inauthentic you sold as new hi-oh DRX the same college-educated paralegals that write the legal work, write plans of action and we do it a lot better and nothing gets farmed out and the other half has to do it.

Intellectual property law, which is defending sellers from baseless claims and also as more and more and more sellers get into private label. We help them establish their trademarks, build in intellectual property rights, obtain their trademarks, protect their copyright. We have a patent lawyers on what’s called of counsel and since that’s where we see the hockey puck going, that’s where we think we should be so.

Our focus is entirely on Amazon sellers, shifting more and more and more towards the sellers that are going into private label. It’S a big area. I mean it’s just the only going to get bigger and and there’s a lot of issues with selling on Amazon that you can run into and it’s kind of a new frontier for a lot of people, because there’s a lot of sellers that are just jumping on There and they’ve never sold before and they’re just starting to sell whatever it may be, without thinking about the the legal issues that could come along with.

If you sell a product and somebody gets hurt with it or their kid eats it, they’re, swallows and chokes or whatever the case may be. I mean there’s a lot of issues there that people can run into so why don’t? We start there on the on the private label side of things and then we’ll go through wholesale and retail arbitrage as well. What are the biggest issues that you see? People, starting out in private label that they’re running into legalize the first thing, any private label sellers should do also I want to get back.

The obstacles should not prevent anybody from giving this market a try. The obstacles are easy to to overcome. It’S a huge opportunity. Just huge the first thing, a private label seller needs to do is first protect their idea and their name and their label. You know we don’t know who’s going to be the next Ralph Lauren or the next Under Armour, the next Nike. So, as you put time and effort into it, it’s really easy for private label sellers to file for their own trademark protection.

While we do do it as a service, you can do it yourself and I’m happy to walk any of your listeners. They schedule appointment with me I’ll teach them how to do it themselves, no charge but file to protect the name that you develop and you should have also filed, protect your the fanciful way going to write it like the way the McDonald’s M is written or the Swoosh for Nike, whatever you come up with, you really should file for protection right away and then the next issue you faces as you do it is you need to protect yourself from whoever is building your products.

You’Re your source of goods is your number-one threat. It’S not the competition, it’s your own factory who they see the product being successful. Will you know, create a hundred thousand units for you and sell it to you and then make another 100 thousand or another five hundred thousand and sell it to dozens or hundreds of accounts? You know in China or Vietnam or India wherever they’re operating.

So you need to protect yourself both domestically and wherever you’re sourcing, your products and those are the top two issues you have to face as you get started for on the trademarks side of things, if you don’t trademark your product, does that basically mean that someone else Can just take your logo and put it on their own product and pretend that they’re you you know it’s, they can do it and you can knock them off, because the United States and Europe and most of the world is what’s called a first to use state.

A first to use system where, if you develop it and you own it, you can knock other people off even if they file after you, you can actually oppose that filing or seek to take that filing away. You can challenge it, but it cost it’s going to take time. It’S going to cost you money, it’s much easier and cheaper to do it at the outset. On the other hand, where you’re sourcing your products and I’m not a Chinese Bashford, I don’t think it’s right, but when you have one country that has like 90 % of all the factories on the planet in one country, that’s where the good stuff comes from and The bad stuff comes from, so China is a first to register a first-to-file, so it’s just easier and cheaper and efficient to do it early on.

If you didn’t do it yesterday, then put on your list to up to dues for tomorrow and again it’s in the u.S.. It’S really really easy. China’S a little more complex yeah and something to keep in mind too, is that the Chinese culture is different than what our culture is here we’re here, we kind of think of it as a bad thing of taking someone else and stuff and running with it in China, that’s kind of expected that, if someone’s being successful, you just copy them and do the same thing and try to be successful yourself, not necessarily right or wrong.

It’S just two completely different cultures, and you got to keep that in mind that you’re dealing with a culture that may not be or think the same as as what we do here about taking someone else’s stuff, that’s entirely correct and, like you know, we grew up And like when you were a kid, if you told so no being a copy-cat, that was a bad thing. You know that doesn’t exist in Chinese culture, so we’ve learned a lot by our team in China and that’s exactly right.

Also in United States. There are different presumptions in China if you don’t file in the specific categories, as hundreds and hundreds of categories you’re presumed not to have rights in those categories where the presumption is the opposite. Here fact, China had no IP law at all to 2012, absolutely zero, but now that they have – and I don’t know if you’re, if you’re a Trump fan or anti Trump – I don’t want to get into politics in terms of intellectual property.

I read a report that there are 15 times as many filings in the u.S. Coming from people located in China. Then the US and Europe combined so they’re filing trademarks and patents here in the US for products that they’re making in China the Chinese that’s right, they’re protecting their rights here as well as they’re at 15 times the rate. Also the government there supports them. So u.S. Sellers US sellers, you really do need you do need to start protecting yourself early and it’s cheap and easy.

You can do it yourself, yeah, definitely and with the trademark too, you have to have that now of Amazon to register your brand and protect your listings on Amazon, because if you don’t register your brand, then you don’t maintain control of your listings and anyone can be Changing your listings, but if you register your brand, those listings that are using that brand are kind of locked down for you and that people can’t just change them to whatever they feel like yeah, a hundred percent right, a hundred percent.

They could also sometimes change the backend use feel to get the registry 1.0. I’M not sure if you still can do that, they call it the deprecating 1.0, but to get into 2.0. Yet you have to have them. Are yeah they’ve completely moved on to 2.0 I’ve? I’Ve got one brand, that’s registered under the 1.0 and I don’t have it trademarked yet, and they keep warning me that I need to get a trademarked or I’m going to lose that.

So I got to get that down here. Pretty quick, so might have talked to you about that. I have for the show here, but a little bit more about to the the supplier issues. What what can you do to protect yourself from a Chinese manufacturer supplier from stealing your product in your logo? Trademark? Okay, you got a dude, really two things, and you really should do them simultaneously. One. You have to develop guanxi with your factory, which means of relationship that face-to-face relationship with your factory or the factory manager, and it’s a long flight.

But it’s not as awful as it sounds. You have to go and visit that you have to let them get to know you. You have to spend some time with them so that if they then sell your products out in the back door, they lose face. If there’s no relationship, there’s nothing culturally. That’S going to stop them from doing that, in fact, it’s good business, so you need to develop a relationship with your factory and you need to maintain that relationship.

It’S absolutely vital. The second thing you need to do is you should file in China once you have? The mark here in the US you can do a wipe o applications to World Intellectual Property Organization and it’s like 300 bucks. It’S really cheap and it gives you some protection in China. But you really should file with the Chinese lawyer in China and hit all the different subcategories that you’re in that you intend to go into.

What it will do is will give you leverage so that either one the factory won’t won’t screw you over. I won’t sell your products out the back door or if they do, you have some leverage to communicate with them in a face-to-face meeting and show we filed here’s the contract and we don’t want to get the government involved either, but you have to stop selling our Products to other sellers and those mechanisms work.

It really is not much litigation on these things. If you walk softly, you have a relationship and you carry a big stick of having filed. You should not have much of a problem all right, so just the having the threat there basically solves most of the problems I like to call it leverage leverage, okay, sounds good, it’s probably better term. Let’S say they do go ahead and do that is the the Chinese government? Are they willing to protect American interests over there from their own citizens? Increasingly, they are especially in some of the hot spots as a whole battle going on the last couple of years.

As to which ancient country or cities going to the IP capital of Asia, yep Hong Kong battling shanje and battling Singapore, so in some of the provinces like in Beijing or Shanghai or in Shenzhen, the courts are very open to hearing you out, but I believe in Court avoidance, okay at all cost. If you can avoid going to court, I think it’s the best thing. There are other mechanisms, since the Chinese are mostly selling here in the US.

If, if you have the mark, okay and they’re, taking your mark and sticking it on their product, they’re very easy to get off, if they’re selling the same exact product, then you need to be a little more creative and that’s one of the things that we focus On we’re not allowed to say we specialize in anything as lawyers in New York, so we focus on it, focus on what we can add to that product or add to the warranty of the product so that nobody else can deliver the same thing like if you’re Selling like a health and beauty item – and it includes a license to log on to a part of your website that gives health and beauty advice.

No one else can sell that license other than you, so they might be able to sell the product. On the one hand, but they can’t also deliver that license so that the consumer is not getting the same thing. It’S almost like buying a new car, a new BMW with the warranty is where $ 50,000. Without the warranty you know not so much always a big issue on Amazon dealing with hijackers and and what I’ve done is.

I just have a cease and desist letter that I’ve – I don’t remember where I got it. It might have been from Scott Volker over on the amazing seller, a template from him, and it basically just says that stop selling the product that they’re not authorized to do that and if they continue to do that, will report them to Amazon or possibly pursue legal Avenues and ninety five, ninety nine percent of time that seems to get them off pretty quickly.

Is there any issue of sending that kind of letter? Is that okay, with Amazon terms or what is your thoughts there? No, we do the same thing. I would just change the verbiage. A bit cuz authorized. Sellers versus unauthorized is specifically something that Amazon will not enforce. Okay, so I would identify something else, but it’s really easy to do. We’Ve the same success rate: where will you send those letters? Most sellers just want to go on doing their business and not risk their account and they’ll either stop selling or they’ll contact.

You and they’ll say: hey, listen. I’Ve got a thousand units left. Can I sell these out and then we’ll move on to something else? I think also by doing that, rather than making a complaint, you are not yet you’re not needlessly killing somebody else’s business, so everyone has mouths to feed and you’re also avoiding the animosity. That comes with making you complain. You know, I don’t think it’s it’s wise business-wise to go nuclear right, because then that seller, their staff, their cousins, brothers, mother’s children, right, can buy your products, return them and also in your ODR.

It goes to the roof or they’ll. Make complaints against you as a buyer and cause you problems. So yes send the C and D letters. I would take out the authorization language of it and it’s very, very effective, and then I would. I would at all possible work out agreements so that people amicably come off your listings, yeah, definitely and I’ve softened up mine a little bit after getting some replies and not like thanked.

I don’t need to be quite so harsh. A lot of these people are just you know there trying to sell products and they’re, not necessarily trying to do anything wrong. For example – and I first my very first products that I listed on Amazon – were these bedsheets that I was originally selling on eBay and I just found a listing, I’m like yeah that looks like the same product. I sent it in and sold on that listing and I never got a cease-and-desist or anything but months down the line.

I’M like I was a hijacker products and I had no idea what I was doing coming from eBay. That’S not an issue. You know you just list your product and it doesn’t really matter so could be something that simple, it could be malicious. You never know so, most of the time it’s not malicious. Most sellers don’t want to get involved in disputes. We negotiated a settlement a few months ago, where that, when the complaint came in our client had already ordered.

You know like two containers full of this particular product, so we were negotiated with the other side’s lawyer in California. Worked out just a licensing agreement where you know X, dollars or X cents per unit would get paid to them. Our seller continued to sell. They continued to make you know roughly the same profit and what our clients inventory is gone. You know she’ll, stop, selling and move on, and I think those agreements are best for everybody, because they avoid all the projects so easy for a buyer or ten buyers to make complaints and just capsize you.

So I believe in working things out amicably trying to avoid court. You know we’re not afraid of court. I’Ve. I’Ve tried more cases that if you took every lawyer, you knew and added up their courtroom experience. I have more than all of them combined. It’S not a place for small and medium sized businesses. The only ones who make out well are the lawyers. So we try to avoid that as much as possible, even though, from time to time you have to go to court to get a restraining order, you have to go to court to free somebody’s money.

You know to get leverage over them or you have to respond in court. We try to avoid it at all possible. Why don’t we move over to like the wholesale side of things for people who are buying products that are branded either for distributors or directly from the manufacturer or whatever, whatever suppliers are coming from? Are there any specific issues that wholesalers need to read out, for? I think you do, I think.

First, you want to try and get distribution agreements. If you can. Okay, they’re not required. Amazon doesn’t enforce distribution or authorization agreements, but if you can get authorization, it’s just going to avoid problems down the road where they won’t make complaints against you or, if you’re, caught up in a net against hijackers, you can easily get out of it. So that’s number one number two.

I would certainly just read the forums. Listen to webinars like this make phone calls and do some research before you invest too heavily in any particular brand or product. The health and beauty industry has had a tremendous crackdown on people selling their products, even though most of their complaints are like a hundred percent baseless. Well, you may want to do some research before you bet the farm on like Johnny B hair products, if they’re very aggressive, even though their complaints are totally ludicrous.

If you get a letter from a law firm like oh four es or somebody else out there, don’t freak out almost most of the IP complaints out there are entirely baseless. I mean that’s one of the reasons why we’re so successful is that the complaints have no grounds in the law. That’S where you can get them dismissed over and over and over again, but I would first try and get distribution agreements and then number two.

Do some research, because if you can avoid a dispute and make money elsewhere, I just think it’s a better thing to do so. The the distribution agreements – that’s something you would get directly from the supplier like I do – have some agreements with certain suppliers, but other ones not really they just send you their product list and start selling. So if that’s the case, do you recommend requesting one from them or do you have like a template that we can use to send them and get it signed yeah? We can send you a template.

It’S no big deal would be no charge. We would send it out to you number two, you, those authorizations usually come from the brand or a brand manager, or maybe a little bit lower on the food chain to your source or your distributor. We want to try and get those also, if you’re, not if you can’t get that you really want to keep fantastic because of your invoices that show where you purchased it from that, can then show a link back to the brand of the number one reason for A sand, suspensions or account suspensions is still this thing called inauthentic, and it’s not claiming that your products are fake if they just want to see where they came from.

So if you buy from a BC distributor, you wan na be able to show that a BC distributor gets it from you know, Hasbro or Marvel or NFL or wherever the product is made or whoever the brand is. You want to be able to show it Shane. All the way back to manufacturer, if you can – and that can be done in several ways, it could be right on the invoice. It could be right in the documents it could be as simple as pictures of the distributor with like the Marvel truck pulling it or copies of their invoices.

If you can get them, but you certainly want to get good invoices and I’ve learned a ton, a ton about what you want, the invoices to have on them and what you don’t want. Your invoices to have it’s a whole separate subject. But quality invoices are vital because Amazon will give you this inauthentic complaint and then you have to give them the invoices for the invoices I’d assume in today’s world. Digital invoices are okay, you don’t to have physical paper copies.

We almost always use paper. Copies almost always have actual paper invoices. We do have electronic ones from time to time, but we’re submitting to Amazon. We almost always have paper and we want paper there’s certain things you want to see on that invoice. You don’t want a pro forma invoice that was made on Excel or any invoice right. On the left hand, side you’ve got where you bought it from distributor name, address website phone number.

You have to make sure that website exists. You have to make sure that phone number works. Okay, you have to know if your Google Earth and it’s going to look like a business, it’s not somebody’s home or like an empty field has to be real, and Amazon is more and more and more calling the distributors to see whether they sold. You know to you on your side of the invoice you want to have like you know your name, your address your phone number, your website, but everything should match the Amazon account.

So if you’re selling under, like you know, ABC cable supplies right, buy your products under ABC table supplies. The email address on your invoice should match the email address on your Amazon account your phone number. Should everything should match, and you know many sellers will violate. Amazon’S rules, which is totally fine with me and they’ll, operate multiple accounts, but you should also then maintain invoices in the names of each of those multiple accounts.

We know Amazon looks to see if the fonts, all Macs and not all different sizes, don’t redact the prices. Even though they say it’s okay, there’s a problem, you want to make sure that it shows that it was paid. You want to make sure the dates of delivery makes sense. You know if you got in trouble on January 1st, you can’t submit an invoice from March 1st. The quantities have to match. Have you shipped in 10000 units? You can’t show it invoice for 5.

You also want the invoice to have as much detail as possible. You don’t want any handwriting on the invoice less there’s a place for, if there’s a place for a signature, somebody should sign it. These. Just some of the things we’ve learned by handling all these non legal suspensions writing plans of actions for inauthentic, so get good, high quality, very detailed invoices. So as far as I’ll first just meant talk about the the multiple seller accounts, so I do have two accounts with approval from Amazon’s.

I was going to say: stop stop the article yeah. No, they are ok with doing it as long as you get their permission. So I opened up a case and told them why I needed a second account for business purposes, because I have two completely separate parts of my business. One part I may eventually sell, so I need to have it separate and they were ok with that. I got approval and I have those emails saved and records of that saved and they know the name of the new account and everything so yeah you it’s against terms.

Unless you tell them and they approve it, then they’re, ok with it, but if they find out you have a second account without getting approval yeah, then they can just shut you down completely yeah. I’M going to tell you. I am I’m a business lawyer. Ok, I’m a business lawyer. So diversity is the key of business. We don’t have all your eggs in one basket by having multiple accounts you are taking on the added risk of getting caught and there are certain things we know you can do to avoid getting caught.

But we don’t know everything, so you still may get caught so you’re taking that extra risk. On the other hand, if you only have one count, your entire livelihood is based upon one account where you’re a Estacio, your entire account gets shut down. You know any day at any time, so there are many many sellers that we work with, that have many many accounts and they do it very well. There are other cells that, as soon as they start having more than one account they get caught and it’s a major problem, so everyone can do, does things differently.

Everybody has different skills. The most successful people we’ve seen multiple accounts are either in specific areas of Brooklyn. New York are in Shenzhen, China and or they literally have six computers with six different hotspots with six different bookkeepers and six different product lines. I mean they never log on. From the same phone – and they walk around with these bags, full of computers and they’re they’re religious about not crossing account from account, and they do a lot of things themselves.

Because if you have, let’s, let’s say, for example, the same bookkeeper right who’s, logging in and pulling reports for you, if that bookkeeper blows, it makes a mistake, your accounts get lengthened. You go out of business for a while. So if you’re going to do it yet be like incredibly careful, oh yeah, but it there’s no Amazon police out there, at least not yet oh yeah, so related accounts you not going to prison, wouldn’t recommend it doing it without Amazon’s permission, because personally I wouldn’t want To take that risk of getting my accounts shut down and lose the entire business that I’ve spent years building up so not a risk I would want to take, which is why I went and got complete permission from Amazon to be able to separate the accounts.

But even with that permission, one of the stipulations in there is that the two accounts cannot sell the same products because they don’t want me to have multiple listings for my same product and be able to take up more spots on the search results than just one. Right you also, even if you have their permission, you have to be careful that if you lose a product on one account, you don’t just boost it on the other one, that’s another way of violating it their their your their terms.

So you really want to be careful if you do have their approval, how you use the and don’t don’t abuse it, because you do have that a lot of people can’t get it. So if you have it certainly don’t risk losing it anything else. We should talk about on the wholesale science side of things before we move on. I know there are some great courses out there. This is a great source of information, a big fan of any Levine and host cell breakthrough to learn a lot from him and there’s just a lot of places that that sellers can learn from on how to be more efficient.

How to be more productive. And I like the Amazon sellers events, for like two reasons: one: you learn a lot: okay and number two. You get inspiration so for those two things, I would recommend that sellers you know get the acknowledged for a broad base of sources. Well, let’s talk a little bit more about the getting the suspensions or Amazon suspensions for inauthentic products. So let’s say that I’m buying from a company I have the invoices and everything, but Amazon says that they’re not legitimate.

I submit those invoices Amazon confirms that maybe the supplier than buying from is selling me illegitimate products. What happens, then? Where is the legal liability in that case, not only on the legal side, but also what will Hamazon do on the legal side? We see practically no liability arising theoretically. Could there be absolutely good a certain amount of statutory damage? You could be liable for what we see like practically zero of that it’s usually just a seller dealing with Amazon or either when a brand is complaining.

They just basically want you to stop notice. There’S a few brands out there that are more aggressive, usually they’re, more aggressive towards offshore sellers, but I think that the risk is very, very minimal of getting stuck in court. That sort of thing it exists, but it’s really small when it comes to Amazon. It’S all about your plan of action. That response you write to Amazon that you know we do it.

We probably send out your ten to fifteen plans of action today. Everything is written here in New York, nothing is outsourced and I’m happy to also teach the listeners how to write it and how to write it in a way that we find that works. So let’s say you know: seller bought items from a well-known distributor and then it turns out that distributor was doing something Shady he ended up with. You know counterfeit products right well the root cause of your problem.

Right, I’m sorry, let me take a step back. A plan of action, chef, three sections root, cause immediate corrective action and a long-term change to your business, so that Amazon’s not going to have a problem you in the future the root cause. You want to write in some positive way that you’re now going to source your products someplace more reputable. You don’t want to admit that you sold counterfeit products because then, if Amazon refuses to amicably put you back on you’re dead in the water, where, if you just write it with different verbiage, you can always take Amazon to arbitration, to get your account reinstated without Amazon’s Consent you they can actually be ordered by an arbitrator to reinstate your selling privileges, so the root cause should identify how you’re going to do it better and every business can do something better, the second, the immediate corrective action immediately.

You should always refund the consumer, their money, any complaint at all, even if they’re pulling a scam on you. Even if the product is a hundred percent, fine give them a refund, they can get it from the A to Z system anyway, offer to send them another. One off, let’s send them another to just do anything you can to try and make that consumer happy. The third section like this is a little more thoughtful.

It’S trying to figure out how you make the whole operation of your business better and there it’s really something you have to describe like in this particular scenario: how you’re going to research and find a new distributor or how you have already researched and identified a new Distributor and trace their products back to the manufacturer so that you and Amazon can be assured that the products are in fact genuine and that’s the basics of a plan of action.

That’S what we do every day and it works. We used to find that persuasive sentences were working. More than bullet points were more were more effective. Now it seems, like sort of a combination is what’s working. The whole exercise is just an exercise in persuasive writing, trying to convince or persuade whoever’s reading it in Hyderabad or Bangalore to reinstate eurasian or your account, rather than asking for more information or or saying.

No so thing that I have run into. Is I’ve contacted a manufacturer directly about selling their products and they told me that they’re not interested in having more Amazon sellers but down the line? I ran into a distributor who is selling their products and is willing to sell them to me to sell on Amazon. Is there any issue there legally, the fantastic and wonderful gray market? Ok, those products just been every product, you can buy it and you can sell it.

Then under US law, you’re not violating everything. Anything at all. It’S called the first sale doctrine as long as you’re, not changing that product and the consumers not getting something materially different than what they would get from any other seller you’re, not violating anything. It doesn’t mean they won’t make a complaint or send you a cease and desist letter. But then you’re right, you’re not doing anything wrong, and I think then you have to make a business decision as an entrepreneur risk versus reward.

How much you’re going to make on that product? What’S the risk of having a problem, even if you’re going to win that fight? You still do that analysis. If it’s to pick up three units of NFL jerseys right before the Superbowl, when the NFL is going, you know bananas knocking sellers off bad decision now. If it’s a hundred thousand genuine New York Giants, jerseys that you can get for a buck each and sell them for fifty, and you can show they’re genuine right and it’s not right for the Superbowl, then go for it.

There’S a lot of money to be made. So everything in my my pin is risk versus reward. You have on the legal side. We would say that there’s not really too much risk there, but Amazon doesn’t necessarily worry about the law and just shutting down your account if they think that you’re selling fraudulent goods or something like that and then you have to go through the process and it can Take weeks or months to get that back up and in the meantime your business fails and goes under what kind of recourse do people have there if they weren’t doing anything wrong, but Amazon shut them down anyways, first of all, you’re going to be stunned.

Okay, when I learned this, I was shocked. I thought that one of the first I learned it from I had to ask them the question: twice the people reading these things. These can play so called the mpa team. I don’t know what it stands for there in India. As far as I’m aware they have zero legal training. I mean zero. Like none, there’s, no paralegal there, there’s no lawyer there. They haven’t been taught about trademark or copyright or patents zero.

Okay. So they get these complaints and they give a they knock people off willy-nilly, as if it’s nothing as if no one’s livelihood is depending upon it. The way we address those you receive the C and D or you receive the complaint. We then contact the complainant. As your lawyer, we say, hey, listen, we’re an IP Firm right, we know Amazon, we know IP law, your complaint is entirely baseless and this is why – and you should withdraw the complaint because you’re causing damages that you’re responsible for for making this baseless complaint and those Letters, I know if it’s because they come from a law firm, okay for just because they’re being called to the carpet, they withdraw their complaints.

You know more often than not we’re. You know there might have been 20 sellers on their product and only one of you stands up to them and they withdraw the complaint if they are either silent or they refuse to withdraw the complaint, then you go to notice dispute at amazon.Com and you see that Right in that email and you send, we will refer to our own legal opinion letter to show there’s no violation, there’s no IP rights, it’s a genuine product being delivered in the same exact fashion, and that is also remarkably successful and then getting Amazon to ignore the Complaint there’s a third mechanism called a counter notice.

It pertains to copyright complaints where, if it’s baseless complaint, a seller can serve encounter notice under under the Digital Millennium Copyright Act and then that business has 17 days to either sue you. Whether complaint disappears as a matter of law and if it’s baseless down with you’re not going to sue you, especially the smaller brands. So those are kinds of three mechanisms and you shouldn’t you shouldn’t be too concerned.

You shouldn’t flip out. If you get a complaint because most of the complaints are entirely baseless on the first sale doctrine – and you were right – you are totally legally permitted to buy and sell that product anyplace you want, even though Amazon tends to overreact in your history. How long does it use take for someone get reinstated if they do get shut down in that way? If it’s an IP complaint, you’re generally looking about two weeks a week to two weeks between contacting the other look, if it’s a lawyer or a brand manager or the brand itself, and if either they respond in an affirmative way or you have to go to notice Dispute, so if it’s an IP and intellectual property can play an IP complaint, you’re, probably looking at a week to two weeks on average, some take much longer.

You know especially there’s like a complaint by a lawyer in like June or July, and I reach out to the lawyer. They says: hey, listen. I thank you for contacting me, but tomorrow I’m going on vacation for two weeks and I can’t look at it till I get back you know. Sometimes life interferes with business on the non legal suspensions you’re. Looking usually about a week. We’Ve heard nightmare stories where people are out two three four months and that whoever’s writing the plans of action are taking.

You know, 10 to 15 days for each revision. It’S usually about a week for your non legal suspensions and about two weeks, vis, intellectual property suspension. Sometimes a lot faster, sometimes a lot slower. That’S generally, what occurs, I feel like there’s a some room here for like a class-action lawsuit against the Amazon or something I’ll. Tell you what what I was thinking about. I’M not a big fan of class actions.

Lawyers. I was involved in mass torts long ago. I had a full head of hair. Well, we are seeing a ton of and we are exploring right now, a ton of times where amazon is just seizing people’s money right, so they have like $ 7,000 of your money and they accuse you of violating blah blah blah. They just say we’re not going to distribute it we’re going to hold it, but they don’t just hold it. They seize it and we’re seeing this occur more and more and more, and even if you sold a counterfeit product, let’s say you sold, you know 10,000 units and a thousand turned out to be counterfeit.

I don’t see where Amazon gets off, seizing all of your money. Mm-Hmm, so we’re exploring how to handle that Amazon sellers each waive their right to go to court in exchange the right to go to arbitration. But I think we’re talking like tens of millions of dollars a year, if not more, of just money. They have seized and often for each seller. The amount is so small, it’s not worth the fight or it’s not worth poking the bear.

So my partner and I have a weekly partnership meeting we’re going to talk about this. What can we offer sellers on a group level where Amazon just has seized their money? Oh, we don’t call it this. These words are not mine, but what a what a person I spoke with thinking about, one of the Las Vegas events: it’s the ofb, a they called it TBA theft by Amazon. Okay, what to do about it? Hey, I I love selling on Amazon and it gets a great platform and I’m making a lot of money doing it.

But as with everything, there’s always issues – and I feel like Amazon is – is kind of eating its own right now and I got a feeling it’s going to come and bite them here, a little bit which, especially if they get some kind of competitor who, who can Take them on which would be really nice, because, even though Amazon is great, when you get one platform, that’s just kind of taking over all of e-commerce, they become the big bully and they can kind of get away with it.

Because I don’t want to be the one who says hey, they can get my account suspended because they Amazon doesn’t like me. I agree, I think, even with all the warts on it, it’s it they’ve, given. I think one of the, if not the greatest one of the greatest opportunities for regular people to get into you, know commerce around the world. I mean really with like a credit card in your cellphone. You can start selling on Amazon, but there are certain issues in Europe: they don’t have as much of a market as they do here.

We’Re like the only country, I think where they have like words, like 63 % of the market. Right now like something crazy, but that definitely is going to be. I think, some reckoning. A lot of us had hoped that jet and Walmart they said they were going to treat sellers a whole lot better than Amazon as a way of building up their market. I don’t really know if that came to fruition or not. I don’t really get the feeling from sellers that they’re being treated better.

You know by jet and Walmart, but hopefully someone comes along that recognizes the the platform gets by by the sellers that are on it. Something will come along eventually, I don’t know if it’s going to be Walmart or jet, I don’t know if they can make that shift or not. Maybe we’ll see, but here that some some upstart, we’ll figure out something new, just like Amazon did and eventually it’ll happen.

You know we all always thought Microsoft would be king of the world and now Microsoft, too kind of thing. You know: yeah got their operating system on your desktop and your laptop, but more and more people are just using their phones and everything else. So they’re kind of pushing down just like IBM, used to be the big name and and now Google Google is being beaten up by Facebook and they’re taking over a lot of their ad dollars.

So technology keeps going things, keep changing and we’re in a world that were what used to take a hundred years to happen now is happening in ten years or less though yeah you also see you know not only, I think, is the stock price of Amazon affected By President Trump the perspective changes, you know, I mean love him or hate him. You know a lot of people, listen to the president, United States and when he says things about Amazon being not being fair in terms using the Postal Service.

I’M not I’m not commenting at all whether that’s accurate or inaccurate, if things like that can affect the perception of a brand. You know like me personally, I hate the idea of Amazon. Go you go to a supermarket. I want to see people there checking out because they need jobs, so I think that’s a huge detriment. So I think I think public opinion will have some effect and I think the President may have sort of started something where people are looking twice and saying.

You know yeah get my stuff, you know next day and it’s great, but what are the negative implications of them, and I think that that could happen in terms of sellers and it could it could help change it for the better yeah most of the people. Listening to this and selling on Amazon, don’t remember my Bell right yeah, you know the whole country, one phone company, you know else on the government said no go and broke them up.

Is that a future of Amazon? Toby Amazon? I don’t know, but I think that sellers sellers should start thinking about joining together. There’S a merchants guild, that’s being created by a by a couple of people here in the Northeast. One was a law professor at Pace, University School of Law is also he’s a tax lawyer. I hope to have more news about it and to be able to tell sellers. Listen, you need to donate to this.

This is going to be like our lobbying group, so hopefully that’ll get off the ground soon and that’s how I would prefer to see it. I always hate the government getting involved in things, especially technology, because I think they they just ruin it more than the help. Slow down the advancement of Technology, especially so I hope they stay out of that, because if they do regulate Amazon, I think it just more cements them as the leader and makes it harder for people new people to get into the game.

But that’s my opinion. I’M a small government guy libertarian, so I I prefer the free markets and stuff like that, but I definitely know exactly what you’re saying with like the Amazon go and stuff like that, it’s kind of nice to have a retailer there or someone checking you out. But at the same time it would be kinda cool just to grab my stuff and leave. So we got to find that bit that balance, and you know people people need jobs and I’m a big believer in technology.

You know I was like first to jump on the Palm Pilot and the boss, Casio boss and technology. I love it, but you know people need jobs. Americans need jobs least. That’S why I pick a before I go on that soapbox. No, can I I do a promo for something else, totally different different change of directions, sure sure go ahead and then, after that, we’ll we’ll move in and talked about some retail arbitrage stuff.

Okay, most of us who are making a living some way or another associate with Amazon, also shop on Amazon. When you shop on Amazon, you can pick Amazon smile, which is a program Amazon. Has it it’s a fantastic program where they donate a small portion of your purchase to the charity that you picked? It doesn’t cost you anything extra as a consumer and there’s a lot of great stuff that Amazon does they help employ.

They have the Amazon smiles. They go into poor neighborhoods of fresh food, there’s a lot of fantastic things. Amazon does, and this is one of them, the charity, that I would ask you to pick. If you don’t already have one, it’s called the Ty Lewis Campbell Foundation. It was founded by a fraternity brother of mine and his wife after they lost their son to brain cancer, ty Lewis, Campbell foundation.

It’S a remarkable group of people that raise a lot of money solely to focus on childhood cancers, so Amazon, smiles, ty, Lewis, Campbell Foundation and I could said to the lake and that sort of stuff yeah. Definitely we can put it in the in the notes down below the article here and sorry for your loss. That’S never never a fun thing to deal with cancer and it seems, like everybody, gets cancer nowadays, just horrible yeah.

That was my toes my buddy and for a knucklehead of a guy really an incredible father, an incredible man. His wife is fantastic, developed this disc on Dacian, but alright retail arbitrage, ya, know and just for everybody. If you go to its smile, Camus’s on comm and I’ve actually used it, I forget to use it sometimes because my Amazon tools that I use don’t work on smile amazon.Com, so I always forget to go there, but I definitely used it and it’s definitely nice to Be able to donate a percentage of your purchases to charity without with no additional cost to you, so definitely check that out and I’ll put that in the notes for you but yeah as far as retail arbitrage.

So this is probably where the the biggest legal issues come in with people I’ll just start off with a story of my own. So I started in Amazon in retail. Arbitrage is where I really got my feet: wet and I’ve sensed move more into wholesale and private label, but I still do some retail arbitrage and one of the most recent think problems. I’Ve ran into with was with Skull, Candy home. They make headphones, yeah very familiar them, so I was selling their product.

They sent me a cease and desist letter from a law firm, and I replied to them that I bought these items at clearance and I’m just reselling them when they’re going they’re gone and then I got paperwork in the mail. Basically, all this legal paperwork, the same thing, my friends over at the forties law – firm yeah – I might have been – I forget – the name of them. I learned Whitney a couple of the guys over there yeah on the bottom.

That’S whose signature it was over all right. So what kind of do they have grounds there or what? What should I do in that case? Usually the grounds are total BS that we see okay, we’ve dealt with Skullcandy before I don’t think there was anything in their warranty or their product and if you were selling genuine Skullcandy headsets, you were not violating anybody’s intellectual property rights, and that letter, in my opinion, Is entirely baseless that should never have been sent.

We’Ve also seen you know, Voorhies. Also, if you do research on the Voorhies law firm, they had this whole article about how they automate brand protection right. So it seems to me and again I don’t work for them alone. I’Ve met the guys a couple of times that they’re just sending these letters out without anybody, even looking at where they’re going, because it’s automated they have a whole like animation on this stuff.

So they send them out. Letters of baseless boardies is very rare if every will withdraw their complaint, but amazon is very acceptable to ignoring them so that we’ve dealt with that. What we call it divorce letters we’ve looked at, I don’t know, I countless countless Lori’s letters. So we’ve been very successful, getting Amazon to ignore it. When Tyler Dillon lawyers over there refused to withdraw their complaints, we didn’t even recently saw a letter where a client of ours bought items at Cole’s and, just like you can buy stuff, it calls and sell it in a garage sale.

You can buy stuff at calls and sell it online. Okay, there’s no difference. It’S the first sale doctrine and Vorian actually sent down a letter. That said, you can’t do this right and was it was absurd, because okay well calls took their money. They now own that property and they weren’t claiming to represent the brands. They were just representing Coles department store and the letter was just ridiculous.

So I would it be what about those letters? They are part of doing business if you won’t want to try and avoid those brands, even though you’re right, it may just get less stress in your life and you your your risk reward benefit analysis. It may be better for you not to get involved, but, like your headphones were most likely. A hunch percent legitimate and fine, just out of them. Persuade Amazon to ignore their complaint and just like Amazon, had a problem with like some of the the refund companies that were out there for a while.

I don’t want to name names. I think Maurice has overdone it. They do done too much buckshot. I think Amazon as a company seems to take their lenders a lot less seriously than they used to because they just do so many of them. So I wouldn’t be too worried about the Voorhies farm, at least right now and boys if you’re reading this, I still think you good guys. Oh, I think your letters are bogus yeah and that’s that’s kind of was my thinking as well.

You know I only had one or two left, so I just pulled them out and I said I’m not going to worry about it, but that’s that’s good to know so if I would have just ignored them, what do you think would they have taken it? Any further would they have open, filed a lawsuit or anything like that like they claimed to, or is it just they’re trying to just making claims with no ammunition behind it? You know I don’t want to draw a lawsuit like I don’t believe in.

Like you know, I don’t be like a mano, a mano and challenge them, but let’s take your situation, I think you’re pretty good. I don’t think I don’t think you should lose any sleep worrying about someone’s going to serve you with papers tomorrow, sure yeah and that’s that’s part of the reason I opened up. The second Amazon account when I’m moving any of my private label or not private label. My retail arbitrage stuff over to that account, and my thinking is that if there’s a claim like that and Amazon closes that account, it won’t hopefully won’t affect my other account, since that account is in good standing and didn’t have the violation on it.

So that’s kind of my thinking there. Maybe Amazon might connect it over and shut that one down, but at least there’s a little extra barrier there too. If there’s any false suspensions on Amazon part I’d say we haven’t seen that happen at all. If you have Amazon’s approval to have a second account, we haven’t seen any connection between products on account. A with products on account, be okay, don’t have they’re from they link him up.

They shut both of them down very good to know so yeah and my thought is on it. I’Ve kind of ignored those letters, the Skullcandy one was the first one that they actually sent me in the mail. So I’m not going to worry about it. It’S just a couple products I pulled it off and I actually return them back to shop Co and got my money back for them. Yeah I’ll just have to going forward I’ll just have to kind of ignore those letters and basically, in my mind, I just make note of those brands and just don’t buy them anymore.

They don’t want my money, I’m not going to buy their products. I guess the way I look at it a lot of times what we do, even if the complaint, even if the cease and desist is entirely baseless. We send out a quick it’s kind of a form letter that says we have looked at it. We take it seriously and we disagree and here’s our response to it. So it’s kind of silly because I don’t know how much they’re charging Skullcandy to send out their forties letter for us to then send out our form.

I know our rates are a whole lot. More reasonable and we do it really really quickly mm-hmm. I think I think, if someone, if someone has to is writing a letter, it should least be like a recognition like just though the respect we received it, we take it seriously, but we disagree or something to that effect. What we’re looking into it just the way we see things you know most people, especially in corporate America, answer to somebody and if you could imagine in that room, did you send out the Voorhies letters? Yes, how many did you send out a hundred? Did you get responses right? So I think when someone is called to the carpet out there? Yes, I got a response from these 98 could focus on the four that blew you off, so not really sure.

If that is entirely accurate, that’s the way we see things and it’s so quick and easy to respond to just simply say we received it and we’re looking into it done done deal. That’S it! Okay, you wouldn’t recommend saying something about the first-sale doctrine or something like that. No, we do we do we. Actually we spell out why they there’s no violation, but just quick and easy just to let them know you received it and to respond yeah.

I would send something back: we do we go through there’s, basically, four areas of intellectual property law, copyright, trademark patent and trade dress. So we have a letter, identifies each of those categories and why there’s no violation, so we send that out. You know my staff to probably do most those letters in, like you know, 10 or 15 minutes for any product, I’m just spawned to it and say you’re wrong.

There’S no and don’t make a complaint, or else you may be responsible for the losses and sometimes the losses are financially relatively small, but have serious consequences like you know, a single mom, raising a child right and say: listen you’ll be responsible for taking off taking away The lively of this single mom in Wisconsin, okay, we’re not going to let that happen idly. Okay, let them know, there’s some problem to the brand.

If they do this or significant income, you know you’re a point. Twenty people in your doing. You know two million dollars a month. Worries could be held responsible for those losses. You know, I think you identify why one you received it. You took it seriously why they’re wrong and their potential liability and that usually stops at least in terms of the voice, letters I think we’re in kind of like the wild frontier right now, where people are just trying lots of little things, and they don’t know.

What’S going to stick what’s going to work, what’s legal, what’s not legal and and hopefully that’ll kind of sort itself out, Amazon will start taking this stuff a little more seriously and not just suspend people’s accounts for basically illegal reasons when you really come down to it. So one brand that people will probably want me to touch on because there’s a lot of conversation on it. Right now is reselling Nike shoes, so Amazon has that gated.

But, for example, myself, my seller count has 800 positive feedback and I’m very good standing and I was able to on get get on gated for Nike shoes. But a lot of people are worried that Amazon is going to send, cease and desist letters and Amazon’s going to shut down your account. What have you seen there in terms of that and what grounds are there there? Well, Amazon is a private business right, so they can make up whatever rules.

They want. There’S no due process that you’re entitled to. If you end up taking Amazon to arbitration, there are certain laws in the state of Washington which governs the contract and the Federal Arbitration Act that would govern. We don’t ever want to go there. My advice to stay away from it. If it’s a gated brand and you’re not already heavily invested, there’s no reason to pick a fight that you don’t need.

So I would tell the listeners and listen I’m a David versus Goliath, guy, okay, I love the fight, but it’s not always good business. So I wouldn’t recommend anyone starts getting into Nike if they have the opportunity and if something is really great there they might want to apply first to see if they can get in. But something like that. It’S just to me. It’S not worth the risk, and I guess where I was going with that is: I am undated.

I bought a few Nikes sent them and sold them haven’t. Had any issue have you had people, clients that have had their accounts shut down from selling Nike we’ve had clients who lost the asons from Nike? I think we’ve had a full of some account suspensions, but we haven’t faced your scenario where you’re, unjaded and you’re allowed to sell and have a problem. Okay, I haven’t faced it and also by the way, if anybody out there ever tells you they know exactly what Amazon’s going to do: they’re full of it yeah, okay, Amazon, one of the great things about the companies that they allow their employees to make decisions for Themselves to inspire creative thinking, one of the bad things about the company that individual people that work there make different decisions than the guy sitting.

Next to them. Oh yeah. He allowed this freedom, so I would say, run-of-the-mill week we haven’t seen people who were unhappy problems. I wouldn’t start selling things that are gated yeah. I hear you I’m now with Amazon. I pulled my hair out some days. Trying to deal is one person will tell me something, I’m like no. You can do that like that guy just did it for me yeah. It’S you go back and forth on that, but that’s a whole nother story.

They don’t necessarily they don’t treat all sellers the same and it could be the same size, seller, same age, seller and they just you know. You see someone else, selling that same product and you’re getting dinged for it. Why? I don’t know, but there’s a Cajun saying that it’s easy to ride the horse in the direction that it’s going all right, yeah I’ve got. I’Ve got the one account that’s about three years old and has 800 positive feedback, 99 percent positive feedback rating, and I’ve noticed that, probably in the last few months, maybe six months, it’s gotten immensely easier for me to get changes to listings and get things done and And they’re, just like basically, yes, sir, we can do that for you.

I guess they’re, probably a benefit of sending in ten to twenty thousand dollars and fees that I’ve every month, they’re uh, they listen to you a little more yeah. It doesn’t seem to hurt. So why don’t I let me take a look at social media here and just see if we have any questions. We’Ve got one question here from flip kings on Instagram: do you have to be an authorized reseller for a brand to sell same brand on Amazon? So I think what he’s asking we kind of touched on already about do you need to be an authorized reseller of a brand to sell it, but the answer is: no, you absolutely do not.

You can buy and sell just about anything. You want in the United States without authorization or permission, but some brands just might be wise to stay away from yeah yeah. It depends on what kind of headache you wan na be left. Yes know how much money you anticipate making if it’s a small amount of money and a big headache, stay away. If it’s tremendous amount of money and a headache, maybe it’s worthwhile yeah yeah, definitely so got ta, weigh the benefits and costs and negatives and positives of that one.

All right. Let’S jump over to Facebook and see what we got all right here. We got one from Alex: what are the top three most common cases you deal with? What are the top three biggest mistakes made by Amazon sellers that open themselves up to litigation or risk? Alright litigation, there’s a very, very little actual litigation? Okay, don’t I don’t want you to like not be concerned about it, but I don’t think you should lose sleep over litigations, very, very little, there’s very, very few lawsuits.

Well, they are increasing a bit against domestic sellers. Okay, top three are inauthentic. They just want to see your invoices number two. Is you sold as new, where people are receiving products that either look a little bit old or damaged or the packaging is like last year’s packaging? It’S not the same as what it looks like in the store and the third are baseless: intellectual property complaints, somebody’s claiming that you, you shouldn’t, be selling OtterBox, tell cellphone cases or something you really have no grounds to do it.

They still make the complaints so inauthentic. You sold is new and IP complaints inauthentic and you sold as new have nothing to do with the law. Although we write tons of those plans of actions every day yeah, so it really comes down to you’re, probably not going to be taken to court. But how much risk are you willing to take with Amazon because they can choose to suspend your compass for any reason, then you have to prove that you didn’t do anything wrong.

Yes, but the litigation risk is very minimal. Okay, all right you! So that’s what you’ve seen so far: yeah yeah and that’s that’s good to know Lacey not to lose sleep over losing your house because they you sold and what what we’re seeing the litigation that we’re seeing the most of isn’t against the domestic sellers. At all. I mean there’s some: it’s usually like a brand suing John Doe one to five hundred but John Doe, one to five hundred actually sellers located in China.

So the vast amount of litigation that exists is against foreign sellers and elation locally. Domestically is really it’s really minimal. You’D be surprised, it’s very minimal least right now, all right, so just lots of threats flying around not a whole lot of follow-through, yes bill, one formal litigation that you asked about early on. You asked about insurance and liability if, like you, know, and harm some, but some product harm.

Somebody Amazon requires you to have liability coverage, although most sellers don’t – and we have yet to see Amazon – ask to see the certificate of insurance, but as a business person, you should create an entity to protect your personal assets and you should buy liability coverage. It’S it’s very, very inexpensive. We always recommend Ashland had an out of Indiana who’s, really focused on e-commerce sellers and their insurance needs.

Okay, now G and it’s easy it’s required. I don’t know why they haven’t plugged away at it to get rid of sellers, but but it it provides two things that are vital one. If you do hurt, some of your product hurts somebody right, it’ll pay, whatever the losses are, but more importantly, they’ll actually provide lawyers to defend you and that’s really. A vital. The obligation to defend by an insurance company is probably more important than the obligation to indemnify for losses, because if you can walk into your local lawyer and get defended, it’s going to cost you an arm and a leg.

That is, I know, that’s extremely important, especially if you have private label brand to protect. If somebody somebody hurt themselves with your product, how important is that, if you’re just selling other people’s products, because if somebody got hurt with their products, wouldn’t they be liable? Or would you still be liable, as the person is sold to them on Amazon? Now, as a as a former plaintiff’s lawyer, okay and I tried cases, car accidents and employment cases, a medical malpractice when you’re starting a lawsuit for someone who is injured, you’re casting a net for everybody, who’s involved in that product.

Now everybody everybody has to defend themselves. So like in your Skullcandy example, if one of your headsets, you know cause someone to lose, you know their hearing or damage their hearing. They understood everybody, including you, and if you have insurance, you just call the carrier like in your car accident and say: hey, listen! I’M getting sued and they would assign a lawyer to defend you in New York, it’s very rare that cases get dismissed until after depositions and after you know it takes about a year to get there.

You have to defend yourself that entire time, so the insurance provides lawyers to do that, for you, where you basically make a phone call and then you’re done dealing with it and you can go about your business while the lawyers defend you on somebody else’s dime, okay And what was the name of the company, then it’s Ashland had an HDD en and she’s in Indiana, its Ashland had an agency or Ashley had an insurance or something like that.

Okay, as far as this this area, I think one I like Aaron, we’re friends. I don’t get anything from anybody if you use any of the vendors I suggest, but it’s nice she’s very responsive and she knows her stuff. Okay, all right, yeah and that’s extremely important in the Amazon space, because it’s a whole nother animal. A lot of people could sell you the insurance, but getting someone who actually knows Amazon is very important to get the specifics there.

Yes yeah it is. You need someone who kind of knows our space yeah. Definitely that is all the questions that I’m seeing so far. So anything that we haven’t touched on that you want to touch on.
